eBay shafted me, advice please?

I don't understand why hardly any of you understand the op? I do and I am pretty blonde.
I feel for the OP here, he paid his sellers fees and bought a new phone as soon as funds appeared in his paypal account from selling his phone, then eBay pull the auction AFTER all of this, so eBay have £30 of OP's money which he owes to the buyer of his phone, as he never had enough funds to fully refund them.
OP IF I were you I would call eBay up. Perhaps get a friend to list the phone for you on their eBay account?
It's the SCAM artists that have ruined it for the genuine sellers/buyers.
You appear to be overlooking the fact that OP refused to sell to original winning bidder, then hadn't sent his own phone off to the second winner even though the seller of the phone he had won afterwards had already posted the phone to him.
So you'd buy from a seller then that sometimes refuses to sell, and other times seems rather slow in bothering to send your goods?

Me personally would not buy from a 0fb seller.
He never went ahead with the first buyer due to the hold of his paypal account, which in a way I don't blame him, it would miff me too, But I would send the item anyway as I could not afford not too, but OP being newbie prob thought what the hell. This is irrelevant anyway.

I don't think it is irrelevant. People are bandying about how ebay have done him wrong- yet on the very first sale he decided to just not bother selling. The 21 day hold would have been flagged up when he listed (so he ignored that), the blurb about binding contracts (which we all know to be untrue but is worth remembering that ebay believe it) was flagged up when he listed, and he ignored that. Then despite having issues he lists again, does not ship th ephone, buys another one which is on its way- when he once again decides to cancel the second sale.
Exactly where does anything in the OP 's history suggest this is an ebay user that any of us would feel comfortable buying from or selling to? So if he's posted it quickly the money could have been released within days.
The pity of it is that people find this part of the forum after something's gone wrong, if the OP had come here when he refused to post the first time, he could have been given advice that would have prevented all this.

You make a good point and one that I think we have all overlooked.
This is a phone so would have been going special delivery. So if OP had gone through with original sale and sent same day, arrived next day - he could have had the funds released 2 days after auction end. OP sold phone to buyer 1
Sale refunded doesn't say it was properly cancelled so Ebay fees still due £40
OP relists phone and opens another paypal accountSo I hadn't posted my phone by this stage, my only option was to refund my buyer but we had a problem, I had paid seller fee's worth £40 which of course eBay/Paypal won't reverse
this will bring up warning signs with Paypal unless the 2nd account was business or premier account which I doubt.Tried selling on eBay again with a new Paypal account, exact same problem however this time I also got limited and they wanted me to confirm this that and the other and then eBay also restricted my account until I confirm the stuff with Paypal, so emailed in all requested and I am then told the limit will not be lifted.

OP uses this money to buy from seller 1 doesn't send phone to buyer 2 who only gets partial refund,not happy obviously,Op you need to get the shortfall into the paypal account to complete the refund asap.
You still have the phone despite selling it twice!!
Seller 1 sends phone
Ebay cancel 2nd sale listing and refund fees of £30 to Ebay account
Paypal probably notice 2nd account and limit this,then reverse funds,so seller 1 has no phone-no money,
Seller 1 probably has email from Paypal saying don't send phone,too late,starts to worry.
Never mind delivery refused,phone should be finding it's way back to seller.(OP have you told seller you have refused delivery and they should get the phone back soon)
Also had you completed the first sale the funds would have been released as soon as feedback or proof of delivery was available,the 21 days was a maximum.
Just one other thing, as you were going to be stuck with the phone for another 24 months I assume this was a contract which still has to be paid.0 -
The way I see it makes it difficult for me to see the OP as anything other than a potential ebay problem buyer and seller.
1) sells phone and then when funds ar e held decides not to sell it after all. That automatically looks odd as far as ebay and paypal are concerned and OP was lucky not to get a neg and get stuck with FVfs (OP did you get your FVfs back and has buyer left feedback yet?)
2) Buys a phone and paypal reverses his payment, that sounds like a bank reversal to me not a whim on the part of paypal- OP can you clarify whether you had all the funds in your paypal account that you needed to buy the new phone or did you need to draw any, however small, from a bank account?
3)sells phone again and still has not shipped it so has now only partly refunded?
On those bare facts I can only be thankful that paypal have closed the account- I certainly wouldn't want to come up against a buyer or a seller like that.

1st auction is now cancelled, I explained the situation, sent a cancel auction request, the guy agreeed and cancelled, no binding contract and seller fees refunded.
eBay didn't save anything, they had made a !!!! up of this, Had they not been involved there would of been no issue, I had the phone with me to post at lunch time. At the moment this guy is £30 down which I can not refund as they will not let me refund from my credit card nor will they let me add my bank account and the other person is a phone down however it did have a return address so will get returned.0 -
Hold appears at the top of the listing format if you look- even on my private account I occasionally get the warning flashed up about it. As for shipping the phone, yes I would have, why wouldn't I?1 - No where is it mentioned when you sign up about a 21 day hold, the first you know about it is when you receive the funds

You'l get a lot more sympathy if you stop blaming paypal and ebay for your mistake. Incidentally, can you confirm whether the second sale attempt was via a new paypal account and if so why weren't you using the original one. AS for payment, to sign up to a seller paypal account you must have had a card or a bank account showing somewhere.
The second buyer will get a full refund as he can take out a full chargeback claim against you and paypal will refund him from your account and then persue you for the money. I can (sort of!) see what's happened here though.
When you first sold the phone on Ebay, all you had to do was send it special delivery, and you'd get your money in either 21 days, or as soon as your buyer left feedback. This is well known, and stated in the PP T&Cs. I mean, you're a "newbie" selling a £400 phone, so of course they want to have some sort of protection against you being a scammer.
By selling it the second time, it then looked suspicious, hence you've now had all the problems.
I find it a little disconcerting that Ebay/Paypal seem to think you're a scammer, yet give you your money back for an item you've bought, despite the seller having already posted it!
Are you sure the -£30 isn't the fees for the initial sale?
I would get on the phone immediately to Paypal and/or Ebay to try and sort it out. If you get a thicko at the end of the phone line, phone again and see if you get anyone better!Should've = Should HAVE (not 'of')
