eBay shafted me, advice please?

Here's a story about eBay at there very best.

So I got a phone I didn't like, shop wouldn't take it back so only option was to keep a phone I didn't like for 24 months or get rid, I chose to get rid.

Opened an eBay account just for this purpose, put a nice pic etc with my user name visable to show I actually had the item and wasn't trying to scam, so anyway phone sold guy paid straight away 21 day hold which didn't suit as I wanted the money to buy another phone and besides I wasn't going to post an item of £400 value without having the money, I explained the situation and refunded the guy, I should of left it there but I didn't.

I went around CeX, Gumtree etc trying to get rid of the phone but it was clear I wasn't going to get anywhere near the value it was worth so went back to eBay.

Relisted, it sold, guy paid straight away and this time no hold So used the money to buy another phone and pay the seller fee's, finally I had got rid of the phone I was a happy chappy.

The next day I receive the following.
Your item(s) have been ended due to concerns we have for the safety of the eBay community. Any fees associated with these listings have been credited to your account

They had cancelled my auction, but it gets better. I then get the following
To assist you, PayPal uses antifraud systems to detect and prevent fraud.

A review of the transaction below raised a suspicion that it may have not been authorised. As a result, we've reversed this transaction.

They reversed payment for the phone I had bought, but the best bit is the other person had already posted the phone to me. So of course get called all the scammers of the day by the seller when in fact I had did nothing wrong.

Paypal account also gets limited and I am asked to verify this that and the other, so I send all in, few hours later I get.
Limitation can not be lifted, your funds will be held for 180 days

So I hadn't posted my phone by this stage, my only option was to refund my buyer but we had a problem, I had paid seller fee's worth £40 which of course eBay/Paypal won't reverse.

So the other persons phone came Special Delivery I refused it so thats the stage we are at now.

All in all a total mess and my only crime was to list a phone as a newbie seller but of course eBay/Paypal will make out I am scam artist of the year.

I found your description of your experience a bit confusing. Even after reading your post, I'm still not exactly sure what happened.

It's in Paypal's terms and conditions:

    https://www.paypal-marketing.co.uk/safetyadvice/PaymentHoldsForEbayItems.htm

We’re committed to providing you and your customers with the fastest, safest payment service on the planet. To help protect our customers in case something goes wrong, we may set aside payments for some sellers in a pending balance for up to 21 days. This gives us time to check that there are no problems with the transaction.

Who does this affect? We’ll set aside payments to sellers whose customers have filed a dispute or chargeback. There are a number of other reasons why we may put your payments into a pending balance. Here are some examples:
    • You have been selling on eBay for less than 90 days
    • You have an eBay feedback score fewer than 100 and have not yet established a record of good performance
    • You have received fewer than 20 Detatiled Seller Ratings on eBay in the last 12 months or your eBay seller performance is below standard
    • You have a high rate of customer disputes or a low eBay feedback percentage
    • You have been a PayPal member for less than 6 months and have limited selling activity
    • You have a sudden change in selling activities (e.g. suddenly selling expensive items, selling large numbers of items, etc.)
    • You happen to be selling in a high risk category such as tickets, travel, gift vouchers, computers, electronics, mobile phones, etc.
Depending on the circumstances, we may set aside payments for a single transaction or for all payments to sellers who meet the criteria above.

You're a new seller, it's annoying for you, I appreciate, but selling an expensive phone, cancelling it, buying a phone and then relisting the original one - it just looks dodgy!

    If I've decipherd correctly....

Event 1: Advertised phone on ebay, it sold but paypal put hold on account so seller cancelled sale
Event 2 tried to sell phone elsewher, no joy, back on ebay, it sold, no hold on funds.
Event 3: Seller then buys a new phone with the paypal funds from his sale, in the meantime paypal reverse the original paypal transaction (from event 2) leaving the phone on route to the OP the subject of a reversed transaction

The OP hasnt sent the phone out to the buyer he sold (not sure whether refunded or not as mentioning a problem with fees) OP has refused dto accept delivery of the new phone he bought. As it has left the other seller and he now has no funds the new seller is calling the OP all the scammers under the sun

When eBay reversed the fund for the phone I bought I refunded my buyer straight away with what ever funds I had.

Still none the wiser. Ebay doesn't suite everyone. Sometimes these things are best done in a pub carpark with a roll of £20s
