    A new user on here about to start the jounrney to re-claim £££'s of inappropriate bank charges!

    A quick query regarding our friends at EGG.

    My account started in Aug 2000 and was closed in Jan 2003 (Egg defaulted me and decided not to notify me for a further 10 months). I was making payments / incurring charges until approx March 2005, when the balance was paid off.

    I sent off a letter last week requesting a list of all charges against my credit card account over last six years, as per template.

    I received a response this morning stating they can not action my request as they have been enable to locate me on their systems. They have asked for further info to help them deal with my request.

    1) Full name......Included in my letter!
    2) Any products I hold with them including account number or card numbers.......I clearly stated my card number in my letter!
    3) Current address plus previous them may have..........Again, I included my current and three previous addresse's in my letter, relative to the when I had my account!

    Basically, they are asking for information that is clearly detailed in my letter.

    I'm sure this is all a delaying tactic but I wondered if anyone else has had similar issues and if I can shortcut the whole letters back and forth / delaying tactics? They have sent back my letter and cheque also.

    Also, when does the clock start ticking for the six years claim period? Is it from requesting the charge information or form submitting a detailed claim?

  • Elastimum: Read back through this thread (especially my posts) and you will see there is normally no need to go to the ombudsman as it just takes a few more letters - which should mean you are still on for getting the money by xmas.

    Froggy08: The large volume of complaints that the banks are receiving means they are simplifying things by sending standard letters. I suspect they just look at everybody's letter for about 2 seconds and then put it in a pile by type of response needed - standard letter 1, standard letter 2, etc. Obviously they put yours in the wrong pile! In my experience Egg don't overly delay just for the sake of it, so just write back to them with the same information again.

    To answer your other question, the clock goes back 6 years from the date of your first reclaim request - i.e. if you sent one today you'd be entitled to all charges since 13th November 2002. If you think there were any charges in late Nov/early Dec 2002 then you could send a reclaim letter now, even before you get all the statements.

    I have successfully claimed over 7k back in credit card charges and have been on the straight and narrow for a while. However I have been caught out by Egg. This is due to the fact I don't check my online statement I just pay by dd.

    Anyway, have followed everything as before and have had this reply back after sending a second letter asking for my money back:

    I'm sorry to read of your feedback regarding these charges.

    As stated by my previous associate these charges are in line with our terms and conditions and have been deemed fair.

    As you refer to in your message regarding the Office of Fair Trading you're correct with their statement in April 2006, however they did actually rule Egg out of this and deemed a £16 charge each time a reasonable and fair charge. This is because Egg offer 24 hour a day service online and over the phone 365 days a year.

    I'm therefore unable to offer any refund on your account.

    This complaint has been logged under the reference EGG/******/2008 and if you'd like this escalating please let me know.

    seems like a standard letter to me. Advise them you want to escalate this charge. No one has confirmed whether the charges are fair or not. Although £16 charge is certainly unfair in my opinion and its likely everyone else will see it that way!
    No you're not a vegetarian if you eat any animal or fish, so do not insult genuine veggies by calling yourself one! :mad:

    I know they seem unfair but I can't seem to find anywhere if Egg have been ruled out of this or not.

    Does anyone else know? Or has anyone recently claimed with Egg?

    The OFT have said they won't automatically consider Egg's £16 default fees to be unfair. This is due to Egg's "exceptional factors"...amongst others, they have a higher credit score requirement, and insist a DD is set up to make monthly payments.
  • You wil get 100% of the Egg £16 recharges refunded plus 8% interest if you are persistent. It will probably take 3 letters.

    I had a claim against Egg for £348 but only asked for £325 to settle my claim against them. However yesterday my own bank account was credited with £350 what success. Glad I had the courage to clear it. Not going down that track again for credit cards. Have managed to claim back interest and charges on Barclaycard & Egg so far over £650.00. I have claimed with success all charges.

    Just working now on husbands Barclaycard. Feel very positive!! Go for it!!:rotfl: :money:
