  • I think we had already threatened legal action so just sent another letter mentioning legal action again but written in bigger letters!!! I don't think it matters really, they just have a series of letters they always work through to try and put people off. If you persevere then they will offer it all eventually. (You can threaten legal action now and then not follow it through and only go to the financial ombudsman if you want.)

    If your account is closed they won't credit it, they will probably send you a cheque.

    LOLOLOL - Ive just got home and found a letter from Egg agreeing to pay me the full amount.... YAY !!!!!

    Only thing though is that they are still saying they are goign to credit my account with them - but my account got closed when my IVA started - so Im assuming I can just cross that bit out and write on my acceptance form that I want them to pay me direct so I can deal with it accordingly??

    I requested my statements from egg. They sent me the list of charges and I sent this back with the template letter claiming them back.

    I got a letter from them basically saying that they would not refund my charges...they are lawful... in the terms and conditions blah blah.

    They list 4 points, essentially:
    1. The credit card agreement clearly states charges will be applied in the event of going over limit or late payment, etc etc
    2. Egg does not believe these T&Cs are unfair. The charges represent a fair 'pre-estimate' of the costs incurred by egg (pre-estimate?)
    3. We try to help our customers avoid incurring charges, if you checked your account on line regularly, this may not have happened
    4. If you're concerned about your credit rating contact Equifax etc etc
    Their final point was them suggesting I contact the Ombudsman if I'm unhappy! I though that was supposed to be my next bargaining chip!! :confused: They state:

    "You now have 6 months from the date of this letter to take your complaint to the Financial Ombudsman Service. A copy of their leaflet is enclosed for your imformation, or you can find out more on www.financial-ombudsman.org.uk"

    What now? Do I go ahead with Step 4: Threaten to take it court? When they've actually suggested the Ombudsman themselves?

    I WANT MY MONEY BACK!

  • I helped a friend reclaim from Egg. If you write back threatening legal action they will send you another letter offering a small amount. If you write back threatening legal action again they will send you a 3rd letter offering the whole amount. You just need to be persistent and not worry about all the legal arguments in that first standard letter they send.

    Agree with miitantconsumer - they have given me courage to persue Egg, and just as I was planning to send a third letter telling them that I was quite prepared to take them to court, I got a letter from them telling me that they were goign to refund me the whole amount. ( Ive sent the form back to accept this, but crossed out the refund into my account bit and written that as I am in an IVA the account is closed, therefore I will accept the refund as a Cheque so I can pay it into my IVA.)

    It is worth it, just be brave and tell them to ferk off!!!!

  • I have just got a letter from Egg today saying No. I have just drafted letter 2 saying that unless they settle my claim I will take them to the county court. I have said without prejudice that I would be willing to accept £300. Total charges with interest are £347.59. Do you think I am being to leient? What do you think my next letter will say from them? Got success with Barclaycard they were a walk in the park compared to Egg.
  • No need to make the £300 offer in my opinion - if you read the rest of this thread you will see you can get it all back just by writing more letters. Would you rather have £300 or £347.59?
  • I am frightened that they won't pay up but have changed my letter to say that I will accept £325. I would be happy with that it is better than nothing!! Will letter number 2 say no again! Don't know what to write after that?? Have had a look through threads but can't find anything.
  • My experience of helping a friend on Egg credit card charges is that they will have a series of 3 letters:-

    1. Get lost we're not paying anything back
    2. Ok, we'll pay you the "difference" over £16 (they reckon the £12 doesn't apply to them and that £16 is fair with Egg credit card)
    3. Ok, we'll pay everything back including 8% interest.

    Doesn't matter what you write in your letters 2 and 3 - just say you're still not happy and will take legal action if they don't give it all back.

    Then after their letter 3 you sign a form as full and final settlement of the complaint and they credit your account or pay you a cheque if your account is closed.

    Good luck - it will feel great when you get it back!
  • Hi i'm new to this but here goes,

    I had a credit card back in 2004-2005 which was fine and i had a few charges for late payments, but i got the card cleared and cut it up.

    The problem was over the next few months i started receiving charge notices to the account even after the account was cleared, and because these charges where added to a zero balance card the amount went into the red, but the worst thing is that on these charges tey kept adding more, more and more charges until i got a debt letter saying i owed £3459, this amount is in full all charges beciase the account was at Zero before it started.

    Anyway after a long disccusion i had no choice but to pay back the amount in full to a debt collection agency which finished this month.

    SO the question is can i reclaim the charge against Egg Card which put me in this posistion?
