    I have read several posts that said put fourteen days instead of the forty but they were after my letter to GE on 19 Nov. I'm not complaining about the length of time they took to respond but the fact that they allegedly can't find the information. (However I also sent SAR to Cap One and MBNA and they both managed to reply within fourteen days).

    What I meant about the SAR not mentioning refunds is that they have obviously assumed that I was requesting the info because I would be registering a claim. The first mention of a refund was made by them in their letter detailing the charges.

    This is a large organisation who must have quite literally thousands and thousands of customers and they can't 'find' the infomation. I just cannot believe that a company this big has systems so poorly organised.

    Other posters who have stated 14 days and then not received their information have no right of complaint under the Data Protection Act. My point was, that the first stage is the longest point. If they say they cannot find your information and you have provided addresses and indetifying markers( ie DOB, etc,etc,) then you can complain to the ICO because they have a duty to keep those records.
    Hope that clarifies the point and apologies if the first post came across as slightly harsh.

    i have had 3 store cards with ge money and have got the claims going through a reclaiming company. ge sent me small amounts to settle in good will first of all, but im still awaiting the rest including littlewood caalogue which they say is ge money too.

    only one of the store cards is current, the others were paid up 2 years ago, but the current one has got to court claim stage. I have had severe financial difficulties and can not afford much. on this account which i have had about 6 years there has been huge charges and ppi. it appears that after i sent a letter to them last june asking for statements and then they asked for 10 to cover the cost which i sent off the 10 pounds was credited to the account. i sent another letter off no reply. then i received a letter saying the debt was sold to a company called LINK in caerphilly. i checked the court papers and would you believe the address of LINK on the top of the court form is the same as ge money. only the address for correspondence is in caerphilly questions : are they LINKED as the name suggest and is a con and they supposedly sold the debt to make things more difficult?

    Some people have won against GE - see the consumeractiongroup forum.

    I gave up. Info was incomplete, incomprehensible, and getting through to them by phone impossible. I eventually got somewhere which showed I had nil balance. I called to check if this was correct, was told yes and direct debits stopped (not by me). They had sucked my energy dry so I gave up the claim for charges. A year later I took advantage of the free credit report through quidco - lo and behold - a default on my file from GE money for £300!! This was dated the day of our conversation.

    Went through the unfair default process, to be told that it wasn't a default, and if I paid half the "outstanding" amount, they would remove it. (Remove a default that isn't there?)

    All for overpriced double glazing - not to mention the PPI when I had only worked for less than three months, was in a trial period with my employer, and the salesman wouldn't leave my home until I signed. Call me stupid, but large corporations should not be allowed to exploit stupidity.

    It's now with a lawyer. Not because of the money, (thankfully I can easily pay the £300 now) but because it's not right that they can treat people like this. Thanks to this site I'm much more financially savvy. Many aren't - and a part of me thinks that the financial services industry is now reaping its just desserts. Corrupt, exploitative and self interested. I hope we come out of this with fairer banking systems and less of a debt culture. Rant over.

    Don't give up.

    PS - I think with GE I got several letters saying they needed more time than the 40 days.

  • The last two posts just go to prove my theory that GE are nothing more than Licensed Bandits!!.

    I am convinced that they are not acting fairly and are making it as difficult as possible to reclaim exhorbitant/unfair charges in the hope that you will not take them on and go away. I, personally, will not be giving up, I am not sure what direction to take at the moment but they will not fob me off!!
  • Hi all, hope someone can help!
    I recently wrote to g e capital about my two store cards, requesting default charges information on both my new look account card and my dorothy perkins account card. They both wrote back, but both sated that they couldn't find information for quite a few months!
    They have put:
    I have been unsuccessful in retrieving some statement data during my investigation, as detiled below. This is due to system issues and the data is not available to us. I appreciate this does not fully meet with your requirements and apologise for any inconvenience this may cause, however, this will be taken into consideration when making any calulations for a refund where applicable.

    There are 3 months missing from my dorothy perkins card, and 5 months missing from the new look. I'm just not sure how to proceed from here. do I write back telling them that this isn't good enough and insist they search again, and wait for however long, or shall I write and try and claim back charges for those months as well s any others, stating that i believe i was wrongfully charged on those months, and woluld like it back unless they can prove otherwise?

    I would write back using an average of the rest of the months for the missing ones and reitaerating your refund claim, its good they have said they will take the missing months into account when calculating the refund.

  • OUTFIT Store Card (GE Money)
    Hi I am reclaiming charges from OUTFIT store card and have had an offer of the difference between £12 & a number of £18 charges. GE Money are handling this query and state:

    "GE Money has reviewed the OFT's publication of its findings into default fee charges along with our own cost base. Our view remains that we are entitled to charge these fees. This is consistent with the OFT's view. The OFT ruling deemed that a £12 fee would be a reasonable charge for costs incurred as a result of breaching the Terms and Conditions of your credit agreement. Our charging structure now supports this ruling. GE Money will only refund the proportion of charges that our customers have incurred that exceed £12"

    They are now suggesting i refer the matter to the FOS.

    Should I take this further via the courts?
