You will save yourself lots of time and hassle if you do!
From what you say they have committed a fundamental breach of your contract.
So you can now sue them for the total outstanding on the contract, not just the late payment.0 -

Before sending an LBA, I decided to give E2Save one last chance. I telephoned 0208 896 5000 and asked to be put through to the E2Save cashback team. Hi guys, wow I wish I had read this before I just took out my line with e2save. basically here's my problem: (not 100% related but its to do wit CPW anyways)
I've seen that everyone says to email dunstone but when I did it for my issue it didn't help. I bought a P1i from CPW store and basically (cut a long story short) they miss-sold the damn thing to me. Found out after two months that they had did this. Too late to cancel contract, and after four months of calls, emails and letters finally got them to agree to cancel it and pay it off.
Now to e2save.
Here's the deal I just bought: 12m 200m 200t 6300 Black o2 £30/m including £20 automatic cashback and Sony Playstation 3 40Gb.
The first thing is when I took it out the guy on the other end of the phone (had to call up because of some issues), took about half an hour reading through all the notes because of the P1i phone. He then had to confirm whether or not they could give me the contract as I think CPW have put a note on the system stating that read customer notes and that I have a habit of returning items (did it once out of being with them for 4 years and having had a total of 6 phones with them exc. P1i).
Anyways he spoke to his manager and then he said yeh it's not a problem.
The things I'm worried about now is:
a) will they honour my "automatic" cashback (I have read the whole forum about their automatic stuff)
and
b) given my "track record" of taking problems up with their head office, legal teams etc. will they send me my PS3 or give me more grief - I've heard that they don't send them in 28days - they pull some lame excuse about how they don't have any in stock but are still willing to take 1000 orders per day (or however many) for deals including the PS3.
I'm hoping you guys can help me!!!

P.S. I agree with mobilejunkie... any problems I've had with CPW have always been solved by a Letter Before Action - simply explicitly state they have ONLY 7 days (or whatever) - you'll get a reply within like 24 hours of them receiving it!!! (Further note - if you have an issue with anything from Phones4u let me know - i work there... i'll tell you the best way around it.)0 -

Quick Update guys:
They are now claiming that instead of sending the PS3 and me receiving it within 28 days as is written on their website, they despatch it 28 days after receipt of your phone and can take 10 - 30 days for delivery.
I've had enough - gonna call once tomorrow on the CPW switchboard (02088965000) and speak to someone ... if not LBA and small claims all the way!!0 -
The way these unscrupulous companies make their money is by ensuring it's as complicated as possible a process for customers to ever claim their cash back. And, unless you send everything by recorded delivery, they'll claim they never received it (including letters). Regarding the post that said it was someone's own fault if they didn't get their cashback - all I can say is, I followed the rules (and I've got a graduate degree from Oxford, so I'm not daft) yet they still found a way out of it. The consumer watch dogs want these sites banned, which says it all, as far as I'm concerned. Boo.0

I'm a Mensan and I totally disagree. I would argue the opposite case; the people taking up these deals see a chance to get something for nothing at the dealer's expense. So who is the real villain? Of course these companies make it "difficult" - and many are totally untrustworthy. However, anyone prepared to do the legwork can ensure they get paid one way or another. I've had dozens of contracts for myself and many other people; only once has one of the others had to sue - and they got their money as predicted without going to court. Meanwhile we've had hundreds of thousands of free mintues and texts, loads of free phones which we have the option of selling at a profit and numerous other benefits (long list). Follow my groundrules, not "theirs" and you will be ok - and suing if needbe is straightforward. Don't ban these deals; put a wealth warning in bold for the unwary. Otherwise sue, get your money and don't do any cashback deal again if you're unhappy. If you really HAVE done it right there is no porblem.
I would add that I don't work for them, have warned people against using them (or doing any cashback deal) for over a year and helped many who get it wrong. However, I ordered another cashback deal this week and am still ordering for several other people who have been more than pleased with my performance with only minor and annoying hiccups.0 -

I've just taken out 3 more such deals with phones4u and, in addition to getting phones worth over £200 (on Ebay), a combined 1550 cross network minutes and 1000 texts per month, I stand to make a profit (via a cashback site) of £180. Why deny people the opportunity to save/make so much money provided they follow the rules (and they're really not that complicated)?0 -

Then after I did call at your customer service and one of your colleges said me that you need to send back your proof of address on this address PO . Box 8840 LE11 9EL so I had sent my original bank statement which states my new address on 5th August 11, 2008 with recorded delivery no.DV401893795GB but still I didn’t got my cash back then today dt 11th August 11, 2008 I did call at e2save cashback customer care no. and one person pick up phone and cut it before I finish. Then after I had call again on that no. and another person lady pick up my phone and she told me that you can’t got your cashback because your address is not match and I told her that I already send my address proof on above address but she told me that’s not correct and she told me that you need to send again on another address. But I can’t because I already send my original document on above address and I don’t have my original mobile bill. So ok today I send my again and again second last bill with my bank statement so give me fever and second time I did recorded delivery Dv413074161GB.
After all this prosier my cashback was rejected. reason was “we need to receive a bill from you no older than 28 days old.” Also I explained to your colleges that I already send my last bill which not older then 28 days old in the time period and so at that time I don't have my last original bill and your query for the 1st rejection was "not match proof of address" nothing else so it means u received my last original bill but u need only my proof of address. so I send u my second last bill with my original bank statement only for your confirmation that i m same person who send u a bill with proof of address because my original last bill was already with u. so how can I send u again & again & I have done 3 times of recorded delivery already.
Your 2nd reason for rejected is “we need to receive a bill from you no older than 28 days old.” But you have already my both bill last & second last as well. So tell me where is my mistake? You have to think about it if we are not satisfied then we are not buying any phone from e2save in future.
I done everything and give me fever and I spend time and money for the three times recorded delivery and also waste money in phone call. So now I want justice.
