been ripped off by e2save, who to contact?

Had an interesting chat with a member of the CPW customer services on Friday.
He said that due to the success of the cashback offers they have had to move from Wednesbury to bigger premises at Dunstable.
He also said that they are also going to start sending cashbacks direct into bank accounts rather than having to wait for the cheques. This surprised me as Dial-a-phone (who also do a number of cashback offers) used to send their cashbacks by direct transfer and then switched to sending cheques to quicken up the process.Cashback earned

Had they not agreed to pay up I would have had no hesitation in going to the small claims court. Its very easy. First you send them a Letter Before Action and tell them that you will commence proceedings if they have not paid up in, say, 10 days. Then you just go to https://www.moneyclaim.gov.uk
In answer to an earlier question, I understand a lot of people have gone down this route and have invariably been paid out with costs assuming they had a proper claim. One customer has sued them eight times so far and got paid out every time! They trade on the fact that many people just give up and go away. Personally I would never let them get away with it.
That was me. Its 6 court actions via MCOL. The other two they paid up from the "letter before action" which I asked them about whilst I was on the phone to CPW Legal regarding claims 5 and 6!
However they have NEVER replied to ANY of my correspondence! They tell me my account is sorted now.
It all started when I took out a contract with E2Jokers. I had had minor problems previously with OSPS but always got paid in the end. E2Save acutally managed to corrupt my account with someone elses name. This resulted in all of my cashback cheques in someone elses name. This has been going on since last July.
I sent several letters to CPW, including one to Charles Dustone by Royal Mail Guaranteed next Day Spec delivery. I had already taken proof of who I was i.e. driving licence, mobile bill, bank statement from account DD comes from to a CPW store. They faxed it to E2Save who said they would contact me in a few days - NO CONTACT.
Then I wrote to CPW Legal Department with copies of all the accounts and wrong cheques listing everything that was wrong - NO RESPONSE.
I then wrote to CPW Legal Dept with "14 days before action letters" in each case. These were also ignored.
In one case I even managed to get a CCJ against them.
The tactics regarding the legal action seem to vary from no reponse then a cheque arrives, to "we are going to defend this as we deny we owe you any money" then a cheque arrives.
I have managed to get CPW Legal to pay some of them direct to my bank account by ringing them.
When I last spoke to CPW Legal they said to me:
"Please dont take any more legal actions here is my name and number.... call me if you have any more problems"!
If they had bothered to answer ANY of my original correspondence I would not have had to take them to Court.
Anyway sent them a FAX last week listing the next round of cashbacks and when they are due - last one in each case. I suggested they may wish to pay me the outstanding amount direct bearing in mind the fact that I have had to take them to Court 6 times and they asked me not to do it again.

I emailed the CEO last Saturday. On Monday I had a reply from TALK TALK!
They asked for details of my home phone number and the bank I use for my DD!
I sent them a curt reply stating they should actually read my letter! This MATTER was to do with mobile contracts and the customer number I provided them with was sufficient to get my details.
I will send the same letter to the CEO, which I also copied to Watchdog, Which, Local Trading Standards once per week till I get a reply!I am NOT a mortgage & insurance adviser - or anything to do with finance, that was put on by the new system I dont know why?!0 -
Is it not possible to send e2save every bill from 5th month onwards, just to be on the safe side?

I had the same letter from e2save (a few weeks back) stating that I'd sent in the wrong bill and therefore as it had slipped past the time frame i was now ineliglble for the chequeback. They went on to say that it had been to the adjudicator who had assessed it, and there was nothing that could be done..blah blah blah.
Well steam was coming out of my ears. I knew that I had done everything correctly including sending the forth bill as it stated on my T&Cs. (After all the bill number is written just below the top right corner.)
I sent a recorded letter to e2save, stating that i had complied correctly and that they had breached the contract twice. Firstly for not paying back the automated cheque of £31 that should have been paid in sept. But now this I enclosed a copy of the T&C's highlighting the relevant parts. I then informed them they had SEVEN working days to pay the monies owed or court action would be taken to recover the debt.
At about the same time I looked on here and funilly enough found this thread, well you could imagine how annoyed I was. I knew then that they were just trying to rip off customers.
I saw the link to charlie dunstan and sent an e-mail direct. I told him that he had a responsiblity as the CEO and that his company was acting in a dishonest and criminal way, and that if they didn't want there good name dragged through the courts they should honour the contracts.
I went on to say that this website alone had over 20 pages of complaints about his companies activities.
I also pointed out that I would not put up with wait 30 days blah. blah. blah.To then be in the same postion again. I made it very clear they had SEVEN working days or the next correspondance would be from the court.
Results so far:
Within 3 hours a text congratulating me on being successful on cashback. then the usual please allow 30 days
Next day another text from another number informing me that my claim was successful and please allow 30 days.
As this was clearly not in the terms that I had offered them. I was going to send a gentle reminder in RED that court action was commencing on Monday.
I open my Yahoo account and low and behold I see an e-mail dated on Wednesday from E2save cust services. Stating they have been forwarded the e-mail from CPW and are very sorry etc etc. All my monies will be paid in full within 14 days £114 which is the first installment.
Folks my advice is:
Gather your evidence, show them why they are wrong.
E-mail Dunstone, ( we all know a lacky replies) he earns enough from us, he should expect to feel the brunt of disgruntled customers.
Without being rude, tell them in plain english that they are in breach and that they are acting dishonestly etc etc.
Show them how many others feel the same.
And tell them you WILL take legal action, after all it doesn't cost much and they will have to pay costs. So your get it all back.
And finally think of yourself as a business, Compose the letter just as they would to you if you didn't pay your bill. It works both ways. I'm convinced that it was the threat of legal action that has made them respond so fast.
After all why would they suddenly respond with all the guff in text messages, and now a gushing letter of apology from the head of cust services.
I sincerely hope it all works out for you guys, just for the simple reason that it's about time big businesses realise they can't walk all over the man in the street, and treat them like s**t.

They totally ignored all my letters and threats but as soon as i started a small claims action a cheque turned up in the post for £80, bog standard cash back letter with no mention of the small claims. They still owe me the court fees and £10 costs for the postage etc so i am waiting to see how they respond to the court.
I have one more bill to send in ( March ) but will send one a month from this month so they cannot claim i have not sent the right one.WHOOOOSHHHHHHHHH……..

I just got a phone from e2save this morning. Switched it on and it's full of a pictures of some girl with her boyfriend. Almost gave this phone to someone as a gift, I'm glad I checked it over first! e2save have said they'll replace it but I've just deleted them and restored the factory settings.0
