And that's the whole problem. People are treated as guilty until proven innocent.

As Antrobus says, it is UK/EU law, it is not the fault of any particular bank.

They wouldn't have admitted anything anyway would they ? they run the risk of losing their job and/or being prosecuted if they do.

I'd like to say thank you for your comments, i AM speaking from a position of years of knowledge, unlike some posters !;) It's good to get input from lots of people, whether they know the business or not, but d.ross seems to find it impossible to accept the fact that in this case he might just be wrong, despite the overwhelming evidence ! :rotfl::rotfl:

I wouldn't work for Barclays for all the tea in China but that doesn't mean that in this case i have to say they're in the wrong here, because they're not.

That really sounds like the patronising thing a member of the bank staff would say.......because they don't really care.

    Are you still here...?

Welcome to HMP England, you have exceeded the amount of Money a serf is allowed to own without criminal investigations in to how a worthless thieving bit of dirt got his hands on it , as you registered the money to us you gave up ownership of it and we will decide if and when you get it back.

It's not a case of who is right or wrong. After all it's not my line of business. It's a case of the whole situation being morally wrong that I'm concerned about. And the way innocent people have to suffer.

As a previous poster has said take it up with your MP/MEP.

I am sure the banks are much impressed with it either - it is another cost for them to bear.

The law is quite straightforward in this respect; the minute a bank suspects that there is something 'dodgy' about the way an account is conducted it is obliged to freeze the account

But with 1,000,000's of transactions a day, it is very likely that no "body" will have suspected that something is "dodgy" at all. A computer algorithm has probably flagged the transactions as unusual (two large deposits in a basic bank account with a low value throughput). But A COMPUTER CANNOT HAVE A SUSPICION.

A suspicion can only exist in the mind of a PERSON. So a person should have reviewed the transaction and decided whether it was suspicious, given all the information available to the bank, then acted accordingly.

If the bank has set its software to automatically freeze accounts where the algorithm highlights unusual transactions, then it is doing so outside the requirements of the law and cannot use the law as an excuse.
