In which case you NOW need to lodge a formal complaint, detailing compensation you require (eg costs of phonecalls and any other expenses caused) and IF you get no joy then complain to the Banking Ombudsman.
re the late payment to the CC company ask Barclays to write to them advising them of why you were unable to pay; this should be noted on your credit files. Your compensation should include late payment fees incurred. In other words IF they made a mistake then they need to (a) compensate you accordingly and (b) put you back in the position you were in before the 'took' your money.

Keep copies of ALL letters sent and save all letters they send you.

Is this the response to your formal complaint? Or to one of your dozens of phone calls to them (think you mentioned £50 in calls at some point in the thread)?

Have you quantified your financial losses to them (in terms of compensation required), your considerable distress and inconvenience (key words for your complaint...check it out on the FOS website), and intimated that in addition some (considerable?) goodwill is required under the circumstances to retain your business?

If the bank was acting on behalf of and on instruction of SOCA, they are not liable for any costs, as Barlcays are complying with the Proceeds of Crime Act 2002. I have seen FOS case studies that have similar circumstances, and in some of them FOS agreed with the firm re their handling of the case.

ARE YOU FOR REAL ??? serious organised crime !!!! on what basis ? all i did was deposit two cheques from my brothers account how can that constitute serious crime !! what a ridiculous comment !

If they suspect money is from the proceeds of crime, which usually appears in the form of out-of-character activity on a person's account, they are obliged to inform their money laundering team and possibly by extension SOCA.

*YOU* know that these cheques came from your brother/Halifax. Barclays don't. Indeed, that they came from your brother doesn't necessarily mean they're not laundered funds.

We've all tried to explain this to the OP, don't think they quite grasp whats happened, despite all the posts explaining it ! They've been refunded now and have logged a complaint with Barclays but still appear to be a bit hysterical about it all ! :rotfl:

With reference to the above post! I cannot believe how insensitive you are. If a Bank took 7k out of your account and then proceeded to blame it on an administrative error I am sure you would be 'hysterical' about it.

Having read through all of this I get the OP's frustration at some of the responses he had. Barclays did a similar thing to me where they removed money from my account in triplicate after I settled a mobile phone contract. At the time it was 2 weeks post birth of my first and only child and they also put it down to an admin error. It was a lot of hassle trying to get my money back as they wanted to 'hold' the transactions incase the payee wanted to 'try' to get the funds again - absolutely disgusting!

The point I am trying to make is that far too many people let these banks walk all over them. Don't wait for them to resolve it, get it sorted the same day - otherwise visit the police and get a crime reference number (my friend did this) and get your money back. Without authorisation it is simply theft and all this SOCA cr5p!! Do me a favour!! Would this guy seriously be posting about this if he was a serious criminal???????

Lots of posters here have tried to help the OP by letting them know what possibly happened in this case. This would never be treated as fraud by any Police force in the country. No-one is accusing the OP of being a criminal, the bank were probably following Money Laundering procedures which, if you read the posts, is explained (more than once) The OP seemed incapable of understanding what lots of posters were trying to tell him, there are a lot of people on this forum who have a great deal of experience in Banking Fraud (i'm one of them) to call SOCA !!!! just shows your ingorance. Please do some Googling and educate yourself before posting things like this.

Yet again you are completely missing the point. There has never been any argument about the procedures that the bank was following. The problem is the way they folllow those procedures, and take so long to do so. It's funny don't you think, that when the OP said they were suicidal, that all of a sudden the case was resolved. If they can sort it so quickly when someone is suicidal then they could have sorted it quicker anyway. It's a prime example of the way the banks just don't care about their customers.
  • Hi
I read several posts about money being removed by Barclays bank under the guise of reconciliation. The same thing happened to me this week. I made complaint after complaint but all I was doing was getting stuck in the rut of procedure. On the fourth day, all the money was returned. The bottom line is this. Something triggers within teh systems which flags your account. Your account is then frozen while investigations are carried out. If you re not involved in anythig illegal, you have nothing to worry about as ALL your money will be returned. You only have to worry if you re involved in something illegal. One thing I point out is that please keep reciepts of your expenditure and ask for compensation for the inconvenience. Also, dont waste your time with calls. hey wont amount to anything.
