Its 40 days from the date the bank are assumed to have received your request.0 -
So, i've sent my letters to my 5 credittors and so far i have had replies from two asking me to fill out another letter stating something to do with DPA and saying it is being dealt with. I sent them all registered so i know when each one was recd.
My bank is the only one that hasn't got any info on their system and no suggestions as to when it will be dealt with. Phoned them again today, and they say they have to send out a letter that i will need to sign re DPA. I said it seems like a duplication of work as i have already specified DPA in my letter and signed it, so surely that will do!!??
So what happens after 400 days if they haven't responded? I’ve phoned them today because I haven’t received my comprehensive list of the default charges, which is over the 40 days, only to be told they haven’t received my letter. I asked how they managed to cash the £10 maximum statutory charge check which was enclosed with the letter and she went quiet. After putting me on hold ‘to find out what had happened’ she told me they had printed out 6 years of statements, kept them on file for a week and then destroyed them. She couldn’t tell me why this happened, told me Nat West can’t provide a list, but will send statements and told me I’ll have to ask the branch why my request wasn’t logged.
Is this a new tactic by the banks? Has anyone else had problems getting the information?

Sent off letters to Lloyds TSB and MBNA on 6th of Jan 2007 asking for details of my charges over the last 6 years, I enclosed postal orders for £10 but did not send by recorded delivery! I have had no reply so far and as 40 day's will soon be up I just wondered if I can expect the banks to claim they did not recieve my letters! If this happens do I have to start the process all over again and wait another 40 days? I have not checked if the postal orders have been cashed yet but will do soon. Hope someone can advise me.

Were they crossed postal orders? I was in the same situation with Bank of Scotland, but as I'd made out crossed postal orders (can only be cashed by the payee on the PO) I could prove that they'd been cashed and it must have been the bank that cashed them! Did you get a certificate of posting? That is also good enough for the courts to assume that the letter was received 2 days after posting, or so I've been told."Think for yourselves and allow others the privilege to do so too." Replys needed rather quickly!
Three and a half weeks ago when I started claiming for my charges I was in credit at the bank. For the last three weeks I have stupidly been overdrawn and Lloyds havent cashed the cheque.
What I would like to know is do I need to start the process again? Do I send them a postal order? Where do I go from here, because I obviously cant ask the bank!
I would be really, really grateful if someone could come back to me ASAP before the four week deadline! (Oh, and is it counted in working days?)

The 40 days is counted from the date they receive the letter, not working days. Did you send it recorded delivery? if so you can prove when they received the letter. I would personally forge ahead after the 40 days and inform the information commissioner, it's not your fault they haven't cashed the cheque yet. Do you have a cheque guarantee card? If so the cheque can still be cashed as it's under the cheque guarantee limit, whether you're overdrawn or not provided a stop hasn't been placed on your account.
