Halifax are terrible. I sent my letter, with a £10 cheque, to them a week ago requesting statements. They have denied receiving it and it went Recorded. Royal Mail can't find out who signed for it either so I'm back to square one and will have to send another letter in. Did they tell you to pay £5 as unless told otherwise the fee is £10?Halifax have only sent the last 2 years cleared my boyfriends overdraft (£1k) without his knowledge and closed his account down without his knowledge. Halifax are now refusing to talk to him because he no longer has an account with them.
The fact the account is closed will not stop you claiming nor will it relieve them of any obligation under the DPA to provide information.My boyfriend has been down to his local branch a number of times and each time they have fobbed him off saying the rest of the statements should arrive within 7 days, they haven't.
What can we do to make Halifax give us the rest of his statements I mean we've paid for them for goodness sakes. I think this is a disgrace please can someone help me I don't know what to do next it's been 4 months
If you are satisfied you have made a proper request under the DPA and the 40 days has expired, the next step is make a complaint to the Data Commissioner. This usually gets things moving. If they still fail to meet their obligation, the court can force them to provide the information.
When you do have all the charges, you can start the process in the article to reclaim them.0 -
According to a few people over at the Consumer Action Group, the Data Commissioner isn't doing anything more than warning the banks to comply, instead of treating it as a breach of the DPA. I've sent £50 worth of cheques for back dated statements (5 different accounts). What i would like to know is if the Banks are breaking any kind of law or code of conduct by cashing the cheques and then not sending the statements after more than a week. I know they have 40 days to comply but surely if they've cashed the checks it doesn't take 40 days to print some statements and send them!!. I've got the taste for blood and i'm not going to put up with any of their c**p. Why do they have to prolong the inevitable!!.
How can i get them to pull their finger out, I've already called but they just said they should be with you between 7-10 days.0 -

I reported one of my banks who failed to get back to me in 40 days, to the info commisioner people, but that was 3 or 4 days ago and ive heard nothing. Is this usual? Do they not confirm your complaint?

Hmm, as well as my own case with my bank, court action pending etc..
Im trying to set the ball rolling for my partners sister.
When i asked for my statements, they sent them within two weeks, I sent the same letter to the same bank for my sister in law and they've responded with the standard " we will get back to you soon, but no later than the 21st Feb " etc..
a new tactic ? How can I pressure them further to hand over the statements ?
