Am I right in thinking that as the item was not as described the costs of return postage should be paid by the seller in this case under distance selling regulations?
Yes, you are right in thinking that.

One of the problems you may have is enforcing it.

You also have to do some research and work out whether a 2% oversize is actually a fault.

The only thing I am thinking is that this item has been misdescribed...

The only information stated was the size (60cmx110cm) , a picture, and the "Technical details":

" Colours: Biscuit Beige & Fresh Cream. Material: 100% Heat Set Polypropylene. Depth: 11mm. Weight: 2.5kg (10lbs) PerSqM. Condition: New. Design Code: 712-Beige Finike. Other Sizes, Designs and Colours Available. For Customer Services and Phone Orders Call: X."

So there was nothing about variance in size, in short. At 2.5kg, i don't think it would be worth sending back for a price paid for the item refund. Needless to say, I won't be buying from The Rug House Ltd again... It's not worth the "saving".

Thank you for your reply Wealdroam.

  • Hi, first post, hopefully not the last :)

I've been searching online like mad bring to find out what my rights are...

I bought a jacket online today in a sale, half price. A few hours after I did though, the shop emailed to say they didn't actually have it, due to an 'admin error', and did I want a refund or an exchange. I actually wanted the jacket. The shop says they won't be restocking the same one. The same jacket has just been restocked in another shop for over twice the price. £200 instead of the £90 I paid. So I asked the shop for £200 credit, as that's what a jacket the same will cost... they're not entertaining that request really but what exactly are my rights? I believe the seller has some obligation but I don't know what exactly.

Any help would be every welcome indeed, thanks for reading :)

Adamo, the short answer is you won't be getting more than a refund.

No a bank statement is not enough.
To charge the batteries you really need a charger of some sort. :D

However, a bank statement will be a suitable proof of purchase if he paid by debit card.
Perhaps that's what you meant. ;)

  • I receive a final demand letter from HSBC. regards of my overdraft of 651. the final demand states within 28 days to arranged a proposal. HSBC, contact me and a arrangement was made. I thought the offer of 20.per month was ok. HSBC state that a token payment on my credit file in the bank, and it was a one of payment. This is not so. I was still a student. HSBC even set the date to start the payments. HSBC took the payment of 20., and the following day they closed all accounts. I have now found from the national debt line that a final demand should of follow up with a default notice. I said I never receive one. I am asking under the CCA 1974, is a final demand a default notice. A token payment is his a one of payment.

    PS
  • The customer service phone number was no good either, repeating the 28 day policy and having little consideration for the SOGA.

I have taken the complaints address off them but hold out little hope.
got a phone call yesterday to say they are giving me a refund. thanks mse and derrick.:)
