Hi - is 26 months reasonable for a Hotpoint undercounter fridge to last? I purchased one in November 2009 and its now not working. I paid £199.99 on a credit card which I have subsequently cancelled. Any help you can give would be appreciated.0

Section 75 of the Consumer Credit Act 1974 makes the credit card company are jointly responsible with the retailer for performance of the contract.
Have a read of MSE's Section 75 Refunds article for further details.
I am pretty sure that it makes no difference that you now no longer have that credit card.0 -
Ebay have ajudicated and agreed that I can have a refund of £575, for really bad/different item sent to me. ebay say I have to pay for return of wrong item - very costly. Its all too much...
1. Are they right?
2. should I go for chargeback as paid via credit card?
3. Can I avoid extra costs to me?0 -

2) you could use the chargeback route if you paid the seller directly by card. If you used a card to pay Paypal, then it becomes more complicated.
3) If the seller is a trader, then you could pursue them via the small claims court for the return postage costs.
You might want to ask these questions on the Ebay board.
Edited to add:
Oh, I see you have posted on the ebay board... with lots more pertinent information too.
Good luck with your quest.0 -
Hi,
I purchased a memory foam mattress a about 11 days a go, since using it I have not had one good night's sleep due to it making me too hot. I have just spoken to the shop where I purchased it and they said they can do nothing as the mattress isn't faulty. At the time of purchase I was not told that I couldn't get a refund on the mattress nor was I told that it may cause me to be too hot. It cost me over £400. To me the mattress is faulty. Is there anything I can do?
Many thanks
Rosco
Maybe a little late, but with memory foam a mattress protector is essential to stop you sweating! With just a sheet you feel like in an inferno0 -
On the 23rd August we arrived in New York for a 4 night stay at The Barclay Intercontinental Hotel. We then ended up staying a further 4 nights due to our flight cancelled due to Hurricane Irene. We did not fly until the 31st August to Las Vegas where we only could spend 4 nights out of 5 nights originally booked.
Due to our flight being cancelled we had to stay a further 4 nights and the Barclay Intercontinental have charged us on the 12.12.11 and debited from our credit card £700.85. I had spoken to my travel company Hayes and Jarvis whilst stranded in New York and they advised us that they would be paying the extended stay amount and I thought this had been done as when we checked out of the hotel they told us we had nothing to pay as our travel company had paid it all. However, you can imagine my shock when I checked my credit card and The Barclay Intercontinental Hotel, New York have taken this amount from my credit card 14 weeks later. My insurance company say my insurance does not cover this, the airline at the time said they would not pay out?? totally confused as to where I go now.0 -
Hi holidaysforever,
I'm sorry that the hotel has charged you and not Hayes & Jarvis for your additional accommodation. As I don't know your full name and booking reference, please can I ask you to get in touch with us at customer.relations@hayesandjarvis.co.uk to send us the details and if possible a scan (or postal copy) of the charges you have received. We'll be happy to look in to it for you and ensure the appropriate refund is made.
Thanks,

hopefully this is a simple enough query. i bought some jvc headphones from asda in september, via their asda direct service with pick up in store. they stopped working a couple of days ago.
i went in store with proof of purchase and was informed by customer services that i could not return them as it was over 28 days. i believe that it is reasonable to expect them to last for more than one month (or the four that it has been since i purchased them).
do i have any rights here with asda or am i best pursuing the issue with jvc? the headphones were only £20 but i feel slightly miffed at having to purchase another pair.
thanks for any assistance.0 -
Hello,
I need some help please. I bought a 12v motorbike on 22nd November as Christmas present for my kids from an online company called Nitroblaze. However, this was out of stock so I asked for a refund. We are now in mid January and I still haven't received my money. I am now £111.80 out of pocket and the company no longer replies to my emails and does not even bother to answer the phone.
Could anyone tell me what my rights are and what I could do to retrieve my money?
Thanks0 -
Quick yes or no question about returning bras.
I've bought a bra on the 1 January, worn twice and hand washed it. I wash each bra separately to make sure nothing gets caught on the fabrics and I wash them gently. When I was hanging up the bra I noticed how the stitching has come undone and the side of the strap is starting to fray.
Can this be considered a faulty product and returned for an exchange? I wouldn't even think of returning it if it was a bra I've worn for a year or more, but it has only been worn twice.
Thanks!0
