I placed an order with a company for a guitar at the beginning of November. When I got home from work on Monday there was a card from Fedex to say they had tried to deliver but no one home. I arranged redelivery via their website which came today - the item I had purchased but also 3 items I hadn't but had my name on. I checked the original card and it said 4 items to be delivered and I checked my bank account and original purchase site - the guitar had been paid for but no mention of the other items. As I had no knowledge of this extra delivery, what are my rights??

i bought a fuji camera in august and used it on holiday in october, when i tried to turn the camera on it kept saying to switch off and on again but still wont work. took it to the shop and the diagnostic came back that it was a cracked circuit board!. they said i had damaged it by impact, which is untrue no damage to camera on the outside, and they want to charge me £102 to have it repaired. i said no. if they want me to pick up the camera but not repair it under the warrenty what is my best chance to have it repaired free. they sent it out of the box to be checked but said it was secure and not damaged,i believe it could have been damaged and they are accountable to repair it.

is it worth fighting for or do i need to take it further.

letter was sent to head office but nothing yet

Contact the company and inform them, tell them they can pick them up at their expense and at a time convenient to you.

You have no rights as the items have obviously been sent in error as against unsolicited, the company will eventually find this error, if you keep them then it will be theft.

I would start with asking for a report from the repair centre stating why they think it was damaged by you, they normally have pretty accurate ways of telling. If you believe the retailer damaged the item i presume that when you handed it in for repair they took note of any damage to the unit and gave you some kind of receipt to note that they have the item? if they noted that there was no visible damage to the unit and there now is then I would say it was the retailer otherwise its a tough case to prove. But as i said earlier i would start with asking for a report from the repair centre. Have you tried following up your letter with an e-mail to the retailers customer service team?

I rang customer services during last week they said they would have another look and send me a letter. On friday night comet at carlisle left me an answer phone message that my camera was ready for collection?. but i suspect that its not been fixed and that its still my "problem",there was no damage on the camera when it went in to be fixed. i have a copy of the recipt when they took it off me---- camera condition was marked good. service sentre said that damage was a cracked circuit board!!!!!. i would like to know how you get one of those damaged during normal use. i am going to collect camera and see if there is any visable damage to it,i will inspect it before anything else and then see what can be done.

    ok

i got a letter this week from head office stating that they WILL NOT fix the camera as damage is deemed my fault. the only damage is internal letter details as follows.

    14th november 2011

    dear mr c**r

further to our recent conversation regarding Fuji S3280 camera.

having looked into the matter further i can advise that upon inspection of the unit by the manufacturer the camera was deemed to have suffered some form of accidental damage, which is not covered by the manufactures guarantee therefore a CHARGEABLE REPAIR was offered.

i can confirm that your product was collected and transported in a specialist box to the manufacturer from the store and there is no evidence to suggest the camera incurred any damage whilst in our care.

i appreciate this is not the response you were hoping for and i apologise for any inconvenience caused

    yours sincerely

well there are a few things that stick out

    1. if there is no evidence to suggest the camera incurred any external damage during transport and the camera condition was good when handed over how did the internal damage present itself?.

    2. they said the camera was inspected by the manufacturer yet the address the camera was sent back from was a company called cam tech not fuji.

    3. as the damage was internal how was it caused---- the damage was a cracked circuit board, but that could have been done by an over tightened screw or any other factor,as there is no external damage to support their claim i damaged it by dropping it etc, how do they explain why the camera would not switch on.

i will be looking into this to see if i have a case under the sale of gods act 1979 as they have to prove i did the damage to the camera, which externaly they have said was not present.
    it was internal.

I ordered curtains from a well jnown catalogue company just over 2 years ago. On washing the colour has come out of one curtain in patches, so the pair no longer match. They were clearly sold as machine washable. However, I am told that their computer records only go back 12 months and its outside its guarantee. Without the product number they can do nothing. Is this correct?

I purchased a recylced rubber sprinkler hose that dripped water around the plants,
From lidl in aprill and connected it to a garden tap to Irrigate, whist i was away on holiday, for two weeks,
The hose was faulty and split in seven places, running me up a LARGE water bill for £407 pounds,(on water meter supply
LIDL supper markets are refusing to pay any compenstion,
a part from a refund of the price of the hose!
would like to take them to court to get my cost back, but advised very difficult to prove in court
ADVISED that to win the case must prove that the hose would not use so much water if it had not split, how do i do that?
    any ideas?

MORAL OF STORY DO NOT TRUST THE QUALITY OF THE HOSE TO WITH STAND WATER PRESSURE, DO NOT BUY FROM LIDL SUPPER MARKETS !

    Hi all

At our company, the laptop I usually use is about to become "excess to requirements". I asked by email if I could purchase this

I received a reply that this would be acceptable as long as all company data was removed from the laptop (standard in all companies). The acceptance was very clear

I requested a price, which was given, and I accepted this price. I asked what would be the acceptable method of payment, and one was given

    All this was via email

Now, I have been told that they have changed their mind

Payment has not yet been made, but in my eyes, looking at various websites on consumer law, this is a contract of sale

So, where do I stand legally?
