    So Kevin, tell us again why you are not going to take the advice offered in post #7.

    Just did, sent them a fax and SP Letter, lets see the outcome.

    They cannot fulfill their part of the contract, they don't have the car, annoying, but quicker to move on and much less expensive than a legal action!

    They cant fulfill their part, do tell that to the clients who pay a deposit, change their minds to buy the car. THEN THEY GET HIT BY THE LEGAL TEAM.

    All i am trying to say is that if you were on the other side of the deal, how do the dealships make you feel.

    Sounds to me like a simple error. You paid deposit to one salesman. He failed to tell the other salesman who actually had a customer there and then with the cash. They offered a refund of the deposit or an alternative vehicle. That sounds quite reasonable to me.

    You'll find another one easily. Mercs of all models are very common now (with the exception of maybe the SLR/SLS). If you're buying new you should be able to spec it out at the dealer anyway. If you aren't buying new then you'll pick up a 3 year old model with reasonable mileage for a decent price.

    Your situation is definitely nothing to cry about, and saying your life is "hell" because you don't have a car for a few days shows what a total sap you are.

    I guess that's the type of people this once quite prestigious brand now attracts.

    @Proc,

    Seems like the 'Green Eyed Monster' is alive and well! :cool:

    Wow! There have been a lot of deleted posts from this thread! We were well over 20 last night.

    I guess the OP took exception to being told it how it is.

    And as my reply to this was one of the deleted posts, here we go again....

    This is totally irrelevant. You are entitled to your deposit back or you can find an alternative vehicle.

    I would be annoyed with them, I would sit down with them and try and get the best deal I could out of them. It does happen - I have had it myself!! Car sold by one salesman without another realising! I would not be taking taxis everywhere and racking up huge bills though, that will not help the cause!

    I also accused him of having a hissy fit.

    Thats well unfair.
    I told a guy who said he was actually crying because a poster told him to nob off trying to sue someone, that he should potentially go to a psychiatrist as i have concerns for their mental wellbeing.

    Then the mods came down on me... was like !!!!!!... what i do?!

    Hello,
    i have saved up for 5 years for this car, walk to my local dealer. Purchased the car i liked, paid deposit + signed contract to pick up in 2 days. I called to check up on the progress on the car, got informed the car got sold to someone else.

    LOL

    Now they got scared called their legal department and got an update that they are in breach of contract and need to provide me with an alternative or refund me my deposit.

    They did, i wanted a diesel they gave me petrol. How does this work? What are my rights? I am paying extra for taxi rides all over as i dont have the car. Mercedes say take what we give you or get lost. How come they dont have any Customer Service?

    :T

    What started out to be an interesting thread has turned sour by personal insults (Guilty as well:)) yet there seems to be something that nearly everyone has ignored, surely I cannot be the only one to have picked this up;
    'Purchased the car I liked, paid deposit + signed contract to pick up in 2 days'.

    Note the part in red, a contract to purchase has been signed. The OP is in the right as the selling company has broken the contact by selling the car to someone else, Final! He is entitled to the deal and specs of car as per contract, the company does not have a leg to stand on.

    Had the OP had walked into the show room and said that he had changed his mind and did not want to purchase the vehicle, do you honestly think the company would have said something like this;

    'That's OK sir, no problem, here is your non refundable deposit returned to you, goodbye and have a nice day' :rotfl:

    I think not.:p

    Do you not understand how disappointed and annoyed the OP was and still is? Sadly not!
