Mercedes sold my car to someone else

Hello,
i have saved up for 5 years for this car, walk to my local dealer. Purchased the car i liked, paid deposit + signed contract to pick up in 2 days. I called to check up on the progress on the car, got informed the car got sold to someone else.
LOL
Now they got scared called their legal department and got an update that they are in breach of contract and need to provide me with an alternative or refund me my deposit.
They did, i wanted a diesel they gave me petrol. How does this work? What are my rights? I am paying extra for taxi rides all over as i dont have the car. Mercedes say take what we give you or get lost. How come they dont have any Customer Service?

Take your refund and buy elsewhere. Or wait for a similar car - they've built 1000s of Mercs0

Surely they have a responsibility to ensure that you aren't out of pocket because of their breach of contract, as well? I would take my deposit back and bill them for all the taxis, etc.....Ex board guide. Signature now changed (if you know, you know).0

I'm assuming that it was the dealer that sold your car and not Mercedes themselves?
I would ask for the deposit back and go elsewhere.Always get a Qualified opinion - My qualifications are that I am OLD and GRUMPY:p:p0 -
I have no issue going to another dealer.
The problem is that till 10th april they were doing free 2 years service which expired. Second of all i cant same spec for same price.
I hate the point i need chase up and bargain people for the price.
I bought the care from InchCape PLC they are Mercedes Offical Dealers.
Now i need to run around like a headless chicken for a problem i have not created.
Secondly if you search for InchCape PLC for hunting down customers who have paid deposit and have not collected the car.
You will be suprised, so point being is that what can i do? I need compensation for the hell they have taken me through.

You are entitled to be put in the position you would have been in had the contract been performed correctly. In other words, you are entitled to buy a car of the same spec elsewhere and, if it costs more, to claim the difference.
Inchcape are not the only Mercedes dealership.0 -

I did, would like to point out these guys are cow boys, cant get any story right. They refused any type of compensation, want to sell me a Petrol instead of Diesel. They said they have spoken to their company lawyers and they have the right to breach the contract. They have given me the alternative and its upto me to pay more and get the petrol vehicle or get lost. BTW again i would like to point outs its Mercedes

They have offered to put the situation right. You have the option to a refund. If you are not happy continuing the sale with this particular dealer, you have the option to go to another.
Any expenses incurred by you "running around like a headless chicken" are your responsibility.
In my opinion, the only thing that has happened to customer service in recent years is that certain customers have become more unreasonable.0 -
So Kevin, tell us again why you are not going to take the advice offered in post #7.0

They cannot fulfill their part of the contract, they don't have the car, annoying, but quicker to move on and much less expensive than a legal action!0
