Guide to the AQ is in the Reclaim Help Thread, link in my signature and I'll pop this into the AQ thread for more answers for you.
and yes, send your list of charges!0 -
Hi - I've just sent the questionnaire back to our court for my son - Barclays also. I sent a list of charges and put his case in section G. we now await a date!0
-
have taken lloyds tsb to court over their charges on my platinum credit card, they have defended the claim basically saying i knew there were bank charges when i opened the account blah blah.
I now though have to fill in the allocation questionnaire sent by the court and would like to know if anyone has any bright ideas what to put for the question 'other information? - to help the judge to manage or clarify the claim...
Should i put down that lloyds bank have previously repaid by bank account charges for example??
any help would be greatly appreciated.
thanks0 -
nope that they have repaid you bank charges is of no relevance to the court for allocation.
hang five I'll get a good paragraph for youLegalBeagles0 -
''I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.
However, the continuing problem is (in common with the 100s of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime.
Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. I believe this would bring a rapid end to this litigation.

thank you so much that sounds perfect
i really was quite surprised lloyds decided to defend considering they had paid out over £600 in charges including interest only a few weeks ago without a fight.
any tips for the day if we actually go to court?0 -
very doubtful you will have to go to court and theres a pretty long way to go before then
Once the Aq is in it will go to the judge for consideration, and he'll send you some directons along with a court date - probably you wont hear for 4 weeks at least - then court date likely to be in June or so.....lol
sorry if that sounds a bit slow but its best to go for worse case scenario.
Once you get the directions from the judge you'll be looking at making up bundles of evidence and whatnot...but dont worry about that yet - most bank settle before you get to that bitLegalBeagles0 -
