whats the defence say ? Its usually best for you to send a copy of your charge schedule to the court and the defendant - you can send it in with your AQ if you like.
5.2% daily interest is rather excessive lol...I assume a typo ?
Can you type out the interest papragraph from your claim so we can see if you need to amend or if its okay. Ta.LegalBeagles0 -
The defence says that the claim does not provide particulars of the account, defence reserves the right to amend statement and goe on about terms and conditions.
I have also just seen that I claimed for 2000 which I would not get back as its beyond 6 years.
The interest paragraph of my claim reads:
The claimant claims interest under
section 69 of the County Courts Act 1984 at
the rate of 8% a year from 13/11/2000 to
5/02/2007 of £178.83 and also interest at
the same rate up to the date of judgment or
earlier payment at a daily rate of 5.25%.
The daily interest rate was a typo. Would i need to amend the details of the claim?

I have filed my claim with Moneyclaim online to which Lloyds TSB have put in a defence I have now received documentation saying that the file has been transferreed to my local claims court and have received a allocation questionnaire to fill out. I am just a bit unsure on the 'Other Information' box included. Am I supposed to be sending copies of my statements showing the charges in with this or is there some other information that requires to be filled in?
Please help as I am a bit dim and don't want to send it off with the wrong information!!!

I have also recieved confirmation that it is being transferred to my local court. They have sent me a Allocation Questionaire but have also requested i send it back with £100. I have already paid MCOL £120 so is this extra £100 correct?0

yep, there is another £100 to pay, unless your on benefits etc. I'm just about to pop to the court and hand mine in....its got to be worth it and i'm certain i will get it back from Abbey when i win0

You'll find a guide to the AQ in the Reclaim Help Thread, link is in my signature. Do a list/spreadsheet of your charges showing the charge, date and description and do several copies of this as you may well need this again.0 -
I will try to keep this as breif as possible,
I have put in a claim for overdraft charges against Lloys tsb, and as I did not
have a satisfactory response from the bank (letter saying "We feel it's fair to
charge for this service") I then started claiming through HMCS money claim
online which cost me £50 as my claim was for £365.
Now the bank has since charged me a further £90 since starting the online
claim. Also, the bank have filed a defence which part of it states "This
Defence is served without prejudice to the defendants?s contention that the
particulars is insufficiently particularised and is embarrassing. The defendant
reserves the right to plead further to the particulars of claim once they are
sufficiently particularised".
Now I had sent two letters to the bank when making my initial caim with a
full schedule of account charges, which I take to mean the above letter
indicates they did not receive. And now they have filed a defence it has to go
through my local County Court. Now before sending my questionaire to the
Court, CAN I ADD THE £90 CHARGE TO MY CLAIM rather than putting in a new
claim or do I forget about claiming it? and if I put in a claim for the £90, would
I send an updated schedule of charges to the Court with a copy to my bank
stating my intention to claim the extra charge?

This is a standard defence from the bank and doesn't mean they haven't received your lists. Guide to your AQ is in the Reclaim Help Thread, link in my signature.
Once you have filed your claim online you can't change this without paying a charge, please see the MCOL FAQ

I have received a Transfer of Proceedings from MCOL to county court. Barclays have filed a defence and it looks like its going to court. Their defence disputes the full amount and outlines a lack of particulars and details to the precise bank charges. Could someone please help with the following on the Allocation Questionnaire?
1. Do I need an 'experts report' at the hearing?
2. I've already paid £120.00 to MCOL, is it right I'm getting charged another £100 for the county court? If so, can I add this to my over all claim?
3. Has anyone heard of it actually going to court at this stage (very afraid!)
4. After using the given templates for filing my claim online, what do I put in 'Other information' on the form and do I send in the list of Bank Charges Interest Calculations?0
