Im about to post it back with my £100 cheque.
In the defence, the bank have stated that I have not given details of every charge, which is of course complete rubbish.
Shall I send a copy in with the allocation Q ??
thanks0 -
I am claiming 6 years of bank charges for my son, the amount is £4770.26 on top of that there is interest £1136.40 taking over the limit for small claims court or does it not sure what way to go. Also stuck on question proposed directions I have no clue as to what it means until I find out I cant send in the paperwork, I am going away for 10 days from Monday so it must get sorted out this weekend at the latest. I would appreciate your help.
Many thanks0 -
You may want to consider reducing your claim to £4999 in order to stick with the small claims court although from reading Martin's article there is no guarentee you'll be heard in a small court anyway!0

I had a simular situation, the interest took my claim over the £5000 limit but the clerk in the court told be that the judge will decide if it should go through the small claim court or not.
Also I may be mistaken but I thought the £5000 limit was before the interest is added.0 -
Your claim is the amount before interest is added therefore under £5,000.

My bank is defnding my claim and the case is going to small claims court. On the allocation questionnaire there is a section for other information, do i need to write in any particulars of my claim or attach the list of charges with interest? Any advice will be greatly appreciated.0

hi all,
I am a newbie on the forum. i have just received my court allocation questionnaire as barclays is disputing my claim. I claimed through mcol and have not sent in any spreadsheets for breakdown of charges. Is that ok? When would I be required to provide these details?
I also made the mistake of asking for 5.2% daily interest as opposed to 0.0002%. Have I jeopardised my case?
Cheers
