    I have entered a claim against Barclays and now they have entered a defence. Usual legal garp..I have the following quesitons.

    1. I will take the Allocation questionnaire to Court tommorow. Do I have to pay another £100 and can I claim that back.

    2. It says I can call a witness, can I call my local barclays Bank Manager or even the chairman of Barclays as a witness to explain how they come up with these charges/costs.

    3. Can I calim for the time I have had to take off work to do this?

    I don't have an answer for this,sorry.But i'm also with Barclays and have sent my first letter to them.Not looking forward to this! :angry: Why does !!!!!! Barclays always have to be the difficult ones?:mad:

    i know its on here somewhere but i'm filling out the ALLOCATION QUESTIONNAIRE to send back to court befor the deadline........
    does anyone know what to put in the box for other information, (anything that will help the judge to manage or clarify the claim, including any other information you consider should be supplied by the other party)
    i've read it once but now can't find it again......
    also how do you claim back the court fees? are they automatically returned if you win?????

  • I'm new to this site and am battling through a Bank charge reclaim with LTSB. They have filed an acknowledgement, but no defence as yet (due to be submitted by next Tuesday 3rd April ~ 28 days are the claim was issued). I was wondering how quick they typically are at submitting their defence? Is it a last minute thing to draw out the process? I havent yet received a court allocation questionnaire, and if it wasnt for the thought of actually receiving over £600 I'd of given up. I'm nervous about potentially having to go to court, but am encouraged by the various comments and threads on this site confirming it's not likely to come to that. Do you think there is any possibility that they wont file a defence given there is less than a week to go? What is the typical timeframe for this process? Any thoughts? Huge thanks!

    Hi Jessie, They may well file a defence at the last minute, its all in an effort to draw out the process. In my case this is what happened, first of all HSBC acknowledge my claim then they filed a defence v. close to the deadline.

    If they do defend the claim you will receive an allocation questionnaire from the court, just fill this in and then send off and wait for a court date, however in my case it didnt get as far as court as I wrote to HSBC solicitors and told them that I had filed an allocation quesionnaire and then received a letter back from them offering me a settlement figure of the full amount requested, previously they had offered to settle for a much lower amount which I rejected, in the end it was worth the wait and they paid out in full without me having to go to court.

    It is a scary process when you are faced with the prospect of going to court however try not to worry too much.....the law is on your side, banks are paying out every single day and if there was a chance that they were not in the wrong millions of people wouldnt be receiving settlement payments.....so as hard and sometimes daunting as it is, stick to your guns. Even if it gets to you actually attending court, it is very unlikely the bank will actually attend in which case the judge will make a decison in their absense.

    Good luck with this.....its sometimes a long drawn out process but worth the wait as I am sure you will receive your money in the end.

    Hi, I need to fill this in by tomorrow at the latest. Basically, Nationwide paid a partial payment of 300 when the actual amount was 400. they disagreed and sent me a list of charges which does not even come close to what it says on my bank statements.

    How could they get it so wrong?

    Anyway, we continued with the court claim and have been sent an allocation questionnaire. So is there anything particular I should put on there?

    What happens now? Can they still pay up or is it going to court time?!!

    lucyloves, you'll find a guide to the Allocation Questionnaire in the Reclaim Help Thread which is linked in my signature. Don't worry about it, its just another step along the way and its unlikely you will end up in court.

    I dont understand and I am baffled. I have received an Adknowledgement of Notice from 20th March from Abbey saying that they will defend claim. It says 28 days? Do I go to court in 28 days? wheres that questionaire allocation? whats an n150 form?

    Help. The amount is around £800 inc. £80 court fees?
