I sent my original letter asking for statements on the 15/2, heard back on the 15th March and sent my template letter off asking for my money back straight away.
On the 13th April I havd a letter saying due to the nature of my complaint my case has been escalated to HO.
Should I just send the next letter out saying I'm taking it further or just go to MCOL?0 -
Hi,
I have written to Woolwich asking for a list of charges applied to my account and enclosed a cheque for £10. They have replied and said that they will respond to my request before 24th May 2007. So far, so good. I anticipated some delaying tactics but was not prepared for the return of my cheque!
As I have sent the maximum amount chargeable and they have chosen to return my payment, does this mean that they must now provide me with the information I require before the date they specify without charge?0 -

Hi,
Its not unusual for some banks not to charge, believe it or not!
Woolwich are saying by returning your check that are providing your information free of charge. Congrats!!
They still are bound to 40 days this is calender days not working days.
So sit back and wait. If they fail to do this in 40 days then report them to the information commissioner.

I got exactly the same letter. I stuck to the deadlines I laid out inthe letter, and sent my second letter 14 days after the first. I didn't get a reply from that one at all, so 14 days after they recieved the second letter (which just happens to be today!), I filed for court action on MCOL.
The letter is a fairly standard letter, so stick to ur deadlines, follow the article exactly as it says, and wait to see what happens... as far as I know, despite the banks defending, no one has actually made it into the court room yet, so u should get a settlement before that happens
Good Luck

Thanks Sarah.
I'll send the second letter off now and see what happens - failing that MCOL.0 -

Depends on how long ago the charges were, and what they were for.
Read the article on the main site for all the information, but the basics of what you can claim are:
Any charge made in the last 6years that is for an unpaid Direct Debit, bounced cheque, or any charge for exceeding your overdraft. You CANNOT claim for interest charged on your overdraft.
If you have any prbs at all, here is the best place to ask questions.
Also take a look at the Consumer Action Group site, there's lots of technical info on there too.'We are all in the gutter, but some of us are looking at the stars' - Oscar Wilde0 -
Hi, this is my first post on the forums but I've been following everyones progress for many weeks.
I sent my first template letter to the Woolwich on 2nd April requesting copies of statments for the past six years.
Next I received back my cheques followed by a letter from Barclays and three from the Woolwich (all the same) acknowledging my first letter!
Today I have recieved a list of all charges to my account for the past 6 years - £1858.50
My question is: At some points (when I was brave) I would telephone the woolwich and try to get the odd overdrawn fee back - sometimes I was successful. I am unsure if they have included these in the list. So do I now go ahead and make a claim based on their list (plus interest) or request another list pointing out my query?
I am tempted to get off the second template letter with the figure they have quoted (plus interest) and wait for their reply.

Unless your confident you know which ones you've had back (does it show on your statements?), I'd just write a letter asking for the full amount they quoted back. If they want to argue the case, let them prove to you which ones they've refunded!
Good Luck
