Sorry it's taken so long to update you but I've been away.

MSS, you were right. I kept trying for a judgement by default but They were allowed to acknowledge on 16th April (I assume the two Bank Holidays added to 14 make the 16) so now we wait some more.

    R:confused:
Hi....Looks like there are loads of us all waiting!!! I have had my claim acknowledged and they are defending. It says Northampton Court...Does anyone know how to get it moved nearer to me?....or will they do that automatically?

    Good luck all

  • Woolwich acknowledged by claim today, they only had til sunday.. im gutted.. now another 28 days.. this is a joke!!!
i started this first week of december! and now its nearly may!!!!!!
Im really cross that they can take the micky like this.

Can anyone tell me the most likely outcome now they have acknowledged?
will they wait the 28 days before disputing the claim?
How much longer could this poss go on!? Why do Woolwich seem to be the worst bank to deal with :-(

Hi.... I think its just 28 days from date of service....not ANOTHER 28 DAYS!. Ie: 14 extra days... I am not sure how long it will take from here....I would like to know too!!

    Hi,
I am claiming back from the Woolwich, and have a "pre-trial review" on 28th June - I still haven't got to the bottom of why a review is necessary, so if anybody else has any light to shine on this, then please do ...
It sounds like it might be drawing things out, and I now just want it all over and done with ...

Anyway, the account in question I am claiming from is now overdrawn because of all the charges Woolwich lumped on it at the end of 2006 and early into 2007 (when I started my claim), and so far, I have kept them at bay with letters each time they have contacted me to get their money back.

However, I have today received a letter from them stating that they are terminating my account, and I have 14 days to pay them their money back (yikes)

I am planning to write and say that I am not prepared to pay them anything until after my hearing, but am a bit worried that they will take further action.
The truth of the matter is, the account is £600 overdrawn with charges and I can't afford to pay it all back now. Should I offer them a small repayment do you think, or shall I just write saying that they'll get their money from me WHEN they pay me mine back - I am claiming £2900 from them!
    PLEASE PLEASE PLEASE help ...

(I am reluctant to pay them anything yet, as they have been absolute pig's in all of this ...)

I cant find much on MSE about pre-trial reviews but there is a thread here on the Consumer Action Group that may answer any questions you have:
    http://www.consumeractiongroup.co.uk/forum/hsbc-bank/79943-no-aq-straight-pre.html

With regard to their demanding repayment of the overdraft. Write and advise that as they are fully aware the account is in dispute. That since the overdraft consists entirely of unlawful charges subject to court action for reclaim that you are not prepared to enter into any arrangement for repayment. Further that following the outcome of court action and judgement in your favour that the overdraft will become void.

They already know this and are trying to play hard ball with you. Kick the ball right back and hard. Any further recovery action at this point is rather pointless and they will only incur themselves costs for pretty much no good reason. Have the confidence that the odds are distinctly on your side here and good luck :)

It'll happen automatically. There's a really good guide to the whole process on the forum index under "Reclaim bank charges help thread"
Good luck - I'm not at that stage yet with the Woolwich but I've a feeling I might be soon
  • I have just started my claim for repayment of bank charges from Woolwich. I sent the template letter and a cheque for 10 pounds. I received a letter acknowledging mine and promising to respond but they returned the cheque. Any idea why? Are they going to try and stop me invoking the Data Protection Act?

Don't worry. They returned my payment too and from what I can gather from the forum we're not the only ones. Sit tight and they'll send you what you requested. I got mine from them within 17 days (roughly) of my request. If it's getting close to the 40 days you could always give them a call to remind them of their obligation.

I think polite, firm and informed replies are the only way to go when dealing with them. My father raised me to discuss without getting overly emotional (bloody hard for a woman that!). His view was always that the first to get emotional and thereby irrational, loses the point and therefore the arguement

That and that there is always, ALWAYS more than one way to approach any given situation in life, you just have to find it.

Stand firm and play the game :)

Hi just registered tonight so hope I have done this post ok just looking at the letter J Animal R posted about the woolwich - I have sent both letters to the woolwich for my husband and I and this started on the 5th march - they have sent the usual letter saying that they are looking into this complaint and then followed it after asking for my charges that they would respond by the 11th and 14th may, what worries be a bit is that The Woolwich is merging with Barclays Bank on the 8th, I am wondering if they can refuse to pay these charges then as they will be Barclays Bank then? But after reading the post J ANIMALR POSTED THAT SCARES ME as well. I couldnt afford to pay my overdraft off either if they closed my account as there wouldnt be enough money paid back if they actually give me any back! This is a fantastic site and the advice is brilliant THANKS I`m hooked every night and love to read about all the people who have got there money back as the banks just target the people like us who havent been afford to keep up with everything due to different circumstances beyond our control - keep up the good work martin and everybody else,
  • Hi Frances

Don't worry too much about Barclays taking over Woolwich, as in doing so they also take on all their liabilities. You would be considered a creditor of the Woolwich at the takeover, so Barclays would still be liable to repay your charges.

Hope that helps to ease your mind a little!
