  • oh, by the way they have 40 days by law to send your statements out, but they dont send statements, just list of charges.
    Halifax- settled £1800 (spent)
    Woolwich settled £505 (spent)
    Capital 1- settled £1345 after defending on mcol (aw:j :j :j

  • hi i posted the 1st draft letter to my bank the woolwhich along with my £10 cheque to recive a copy of my default bank charges or bank statemnets for last 5 or 6 years i got a reply 2 days later with my cheque back i was confussed as the cheque had a date stamped on the back and there was no record of my statments or record of my default charges......

    now im confussed i get a few feelings wots going on my 1st reaction is that they are holding there hands up and are going to make me a offer.
    but i dnt know wither this is time to delay the issue untill the O F T report comes out and the F5A respond to it.
    the thing is if they make me a offer i dnt really know if its a fair offer because i havnt tallyed up the amount due to me.

    has anyone been in this situation plz rply back

    The bank has regarded a request for data as a complaint and has deliberately chosen to put it through their own complaints procedure. I advise to write back immediately and reiterate your request enclosing another £10 cheque and pointing out their error in assuming complaint. State clearly you wish to make a Subject Access Request under the Data Protection Act 1998, you have enclosed the statutory fee and they now have 40 days to respond in full. Failure to do so will result in complaint to the Information Commissioner.

    It may be that they send back the cheque again because they dont charge for the service but the way in which they worded their letter suggests they are sidestepping your rights under the Act. It isnt acceptable.

    If you are with HSBC you can view your 6 years statements online, just a thought. Good luck :)

    With regard to the awaited OFT report it has now been put on hold. Your rights to claim are not compromised and there is no hurry at all to do so. Please see the thread for more information on this:

    Just received an offer of £6800 from Barclays. Original claim was for £8789.50 plus interest. MCOL claim issued same day as offer letter "written". Time to consider options.

    Hello fellow Woolwich claimants

    Just to let you know that today was the final day for the Woolwich to get back to me from the original date quoted in their first reply to my initial 1st letter. On my return from work I have found a letter offering to settle for £1260 (I was claiming £1290). I can't believe it was so easy. My thanks to all of you who have post regular updates. My settlement is going toward paying off my overdraft and also my credit card bill which I never thought that I would be able to do.

    My timeline was as follows:

    1st letter sent 28th February
    Reply received stateing that they would hope to resolve my complaint by the 29th March
    2nd letter sent after time stipulated by Martin and his team
    Received today in the post offer for £1260.

    Here's hopeing all goes well for the rest of you.

    Congratulations Cornish Pasty! There seems to be a pattern of them sticking to their dates to resolve our "complaints". (See Rigsy also) Im due to file MCOL on the 9th April but they have promised to resolve my complaint by 12th April. Not sure what I will do? Probably stick to my dates!!

    I'd say go for it, which is what I would have done if they hadn't come through on time. Although to be fair the the Woolwich aka Barclays came through by the time specified. I can't quite seem to work out why some people like me have a pretty straight forward settlement whilst others have to jump through hoops to get their money back.

    I shall keep watching the Woolwich thread with interest in the hope that the rest of you get the money back that you deserve.

    Take heart fellow Woolwich claimants when I first started out on this road nearly everyone was saying how hard it was to crack this bank. I think me and others have proved otherwise.

    I sent my letter off to Woolwich, as per the template on this site. They owe me loads, as at one point I was paying £200 a month in bank fees.

    Well today I had a letter, enclosing a customer care brouchure, returning my £10 cheque, stating :

    "We have taken responsibility for fully investigating the issues you have raised and we aim to provide you with an answer by 30 April 2007"

    So they didn't get our statements. Are they pulling a fast one? Do they think, 'she doesn't know how much we owe her, we'll give her a figure and she'll go away' ? Or is it just a standard letter? Anyone else get their cheque back?

    Woolwich/Barclays always return the cheque and that is a standard automated response we all recieve... yawn!

    Assuming that was the SAR you sent, they now have 40 days.
