Just to let u know as per my previous post. I sent the template letter on the 21/02 got the usual letter saying it would be resolved by the 20th of this month. I was initially claiming my estimaye of £830 hadnt heard anyting by the 20th and rang up to point out that the letter sated the problem would be RESOLVED by the 22nd, Iwas then told that my charges were £1950!!!!!I pointed out that I havent even had my list of charges from them yet and that if the case wasnt resolved in the next 24 hrs I would put them incourt .I then finshed the call by saying how good the person Iwas speaking to was at her job and that she was very helpful and professional. I then added that Iwould accept £1500.
Today I got a letter offering £1414 which will be in my bank within 10 days , RESULT
A bit of flattery gets you everywhere good luck all, 1 letter ,2 phone calls and £1500 better of! Anyone fancy a pint?
Has anyone tried Capital One? Thats round 2.0 -
Hi Miss Somewhere Sunny and fellow Woolwichers
I haven't seen a 7 day letter, so I just sent mine saying that if I didn't hear from them in 14 days I would be taking them to court. I am claiming £4194.00 from them. I Think I would settle for £3500.00 if they offered but can't help thinking its still £600 short (a lot of money). I wander if things were the other way round and I owed the bank £4194.00 would they settle for £3500.00 - I think not.
Let us know how you get on, I will update also.0 -
Hi searla...thanks for your reply! I shall go ahead with the fourteen day letter as per the template. I am dealing with both mine and My Husbands claim which total an ashamed £6200 plus £1500 interest. I havent thought about how much I would settle for as I would really like to go the whole way and recover the interest as well. It may well take time but I have waited this long I think I can wait a bit longer!! I would rather give the interest to charity than let the bank keep it! Also this is a one off claim as I promise never ever to get charged again!!
Fingers crossed for us all!

An Update.
Following on from previous posts on this thread (#65,97,124) still no joy from Woolwich/Barclays.
Visited MCOL this morning and filed my claim. No surprise really, just a shame they don't settle as quickly as some other banks seem to do.
No gain without pain, etc.

Has anyone had this problem?
I received a list of "all" the charges applied to my account since 2001 which totalled £1730.50
I was expecting it to be more but assumed that the figure would be correct.
I was just about to send of my letter claiming this amount when I had a look through the list and at a quick glance can see several charges not listed.
(I have about a years worth of statements and all the charges for last year are not on the list, as well as some I know of from 3 years ago as I know I had lots of charges in the month I got married, and its only showing 2. and only 4 charges in the whole of 2001, I definatly know thats not right!!!)
Just wondered what I should do?0 -

Common tactic. Had an incomplete list myself and was mildy insulted at the audacity. Write to them advising you are aware that this list does not show all charges and reiterate your request for full details of all charges to the account and give them however long is now left of the original 40 day time period for such a request. If its over the 40 days ask for them by return of post or in a timescale to suit you.
Advise them that if they cannot provide full details as a list then copy statements will be acceptable. Given that failure to provide as a list is their responsibility you are not liable for any further charge for substitution with statements. Good luck0 -
I've been very lucky and have been paid out in full by HSBC and Capital One. However, the Woolwich and Barclays haven't offered anything at all and I've now been given a court date.
I just wanted to know if anyone has had this problem with these two banks and did you actually get to court or did they pay out before then??
Any advice much appreciated!0 -

Most banks pay before court but if it does get that far dont worry no bank has ever turned up and you win by default. Its a way for them to just drag it out as long as possible really.
Read here for a post about Barclays and what actually happened in court. Its reassuring and inspiring:
Top thanks to OP showmethemoney! for her post.
