First week of april a report is due from the OFT, it won't mean a sausage legally, but may encourage the banks to take things mor eoften to the court steps before settling IN FULL.
They didn't send a letter originally asking for the charges, they phoned up and requested them over the phone, then received that letter the day after..

Once again great advice from Es... they will try everything they can to get out of these charges.. As Es rightly says, if its written down then there is no dispute... Don't accept calls either..

hi all :hello:
I have two accounts with the above bank
I worked out I with the claims calculator that I was owed roughly£1400 with £300 worth of interest on top so in total roughly £1700 on one account and £60 on the other.
anyway I sent off the template letter which mentions - the amount which court will award.
The woolwich have offered to pay the £60 on one account and they have offered £1080 on the other and to telephone them if I need to discuss things further. tbh I dont really want the hassle of going to court and i am half surprised at the offer, but on the other hand I think am I walking away from £400 -700 which quite frankly would pay off one of my outsanding credit card balances?
so my questions are?
How likely is it I could negotiate to receive money back for the charges (possibly minus the interest) without going to court?
Has anyonne done this?
and as a worse case scenario what is the cost and process for going to court?

As you aren't entitled to the interest unless it goes to court the banks won't make an offer including interest at this stage.
Cost of going to court is an initial £120 and then if the bank defend you'll have a further £100 but this is all recoverable. You'll find the link to MoneyClaim in Martin's article where you can read about the court process doing it online.0 -

They will probably send in a defence but they will end up paying you anyway.. its just a scaring tactic..

thanks, i will wait and see what happens next then.... i 'll keep you all posted as to how i get on. hopefully it will be a victory and spur on all you others who are having trouble with the woolwich/barclays corporation!!0

Hello
I have just sent my letter before action to the Woolwich. I did call them first to see if there had been any progress, and just got the usual "well you know we have had a lot of cases and yours will be dealt with as soon as possible". But their two weeks are up so I have sent my letter threatening court action.
I will post any updates to keep you informed. There doesn't seem to be many of us Woolwich customers on here and they do seem to be more difficult than some other banks.

Hi! Im a woolwich customer claiming back my charges, and am at the same stage as you. I will be sending my LBA on Saturday! I havent heard anything from them apart from acknowledgement of my "Complaint!" telling me that they will reply by 12th April so I wont be sticking to their timetable but mine!
The next template letter, threatning court action allows them 14 days, but some people on this site refer to a 7 day letter? Whats that then?
