    You need to read some of the websites linked to in this thread. If you have access to an address in England and Wales and would be prepared to travel to court there should you be called to attend you can do it that way or alternatively hand your claim over the Financial Ombudsman who will complete your claim for you.

    Hi All,I am new to this if i post a letter i cannot find 3rd time lucky
    Help is neaded to guide me to use this site as it the best of all but i cannot get my thread to see what is on it.ok for that as i am not here to talk about how to and how not to.
    I am claiming in Scotland against the A & l sent the first letter got answer back with charges sent second letter got an answer today saying it was only for credit cards not for current accounts and they are not refunding any charges on my current account so i phoned them did not get anywhere they said to send a small note to say why i was getting charged so i have got a letter to send by recorded delivery tomorrow to say i would go to court if they do not responed to in 7 days and to say why i was charged.
    I am getting to the staged i do not know what to do.
    Is there anybody knows anyone in Scotland who has won?

    I am claiming £1.150 so i take it is under £1.500 for Scotland

  • Sorry to bother you all but can anyone tell me when claiming back bank fees from Scotland is there an online way to file small claims, also if your fees add up to more than £750 how do i go about claiming back all the amount as in Scotland they will only let you claim that amount in small claims.Last 1 i promise if i can claim all the amount back do i have to pay for seperate claims?:

    There is no online method in Scotland so you have to claim via your local court. Have a read through some of the links in this thread as they will help you with claims up to £1500.

I went into the BOS branch, and after one full hour, no-one could tell where the money went and who took it. Subsequent enquiries over following days gave answers that I withdrew it myself at another ATM (no), it was set against your mortgage arrears (no, there were none). About a month later, I noticed that £70 had been credited to my overdraft around that date. When questioned about it, BOS could not find who authorised the removal of the £70 from the savings account, indeed I felt that they were stalling.

    Taking money without giving notice, at any point? Devious! I knew what was coming next: they were planning to clear the £1.5k overdraft on the next pay-day, and leave me with all my DDs and SOs unpaid ( they did this once before!). Quickly, I converted an old, dormant Nationwide savings account into a FlexAccount, and parachuted all the DDs and SOs and both salaries into that, and sat back and waited. The squealing letters arrived soon thereafter. I'll bet I ruined someone's plans that day! :D I finally paid off the overdraft last year (on MY terms!!) and am now going after them for >£2k worth of charges! Don't be afraid: go get them before the Law is changed!
  • Hi, I'm new to all of this and have never used a forum. I have been reading everyones replies and want to know what the CAG forum is and where do I find it and how do I sign up to it.

    Incidently I had posed a thread a few days ago on this forum and cannot find it. Any suggestions on how to do this? I do not mean to sound stupid but literally have no clue.

  • Well it's been another good Saturday.

    Just received my copy of the charge certificate I had served on the BoS.

    As part of the process the Sheriff officers have to serve a debt advice pack on the BoS at the same time!:rotfl: Ha ha, brilliant!
    I Joe Bloggs (Sheriff Officer) by virtue of the extract decree, in her majesty's name and authority and in the name and authority of the sheriff, CHARGE you to pay the sum set out as below(together with any further interest) within FOURTEEN days after the date of this CHARGE to Donaldtramp. If you do not pay this sum within FOURTEEN days you are liable to have further action taken against you. This may include arrestment of your earnings; arrestment of other property; attachment and auction of property held outwith a dwellinghouse and if the Sheriff so orders, attachment and auction of property held within a dwellinghouse. You are also liable to be sequistrated (declared bankrupt)

    The CHARGE and debt advice pack are served on you today by my leaving and is witnessed by Joe Bloggs 2 (Sheriff Officer 2)
    This might explain the 3 rushed phone calls I received from the bank on Friday!!! They were flapping like you wouldn't believe! MAGIC!!!:rotfl:

    Nice to see some stress on them instead of us eh?:T

    Now for my question. I take it seeing that this was served on the 4th April, more than 14 days ago, I can send the Sheriff Officers in?

    I can't wait till Monday!!! I just hope they don't pay up in the next few days. I want to pay for the sheriff officers to go in!!! I'll be straight onto them first thing Monday!

    First off, I am totalling charges for my mother who is with Bank of Scotland (Halifax)
    I have a slight concern that her charges total in excess of £3,000.
    I am right in saying small claims court is not an option because we are in Scotland and max claim is £750?

    If so would it be worth doing the whole "reclaim process" 4 or 5 times to get all the money back?

    Or can the financial ombudsman takeover?

    What would be my options here?

    Many thanks for any help. Any suggestions welcome
