Can you help?
Claiming against Lloyds, both accounts in England. We have been living in Scotland for the last year, we have a house in Harrogate. Where is the best place to file my claim? and will living in Scotland hamper my £5K claim??

If you can use the Harrogate address for your correspondence then you can file in England, 6 years and a £5,000 limit for small claims. You can then use MCOL but obviously should it come to going to court you would need to travel to Harrogate for that.0

what court do I take tsb bank to court in scotland and how much will it cost me and how do I contact the court?0

Hi guys,
can anyone give me some help, i have worked out through statements the total so far 2440.00 still to get hold of 2001-2005 statements, my concern is that in Scotland the small claims limit is 750.00, my question is should i break it up into small claims or go for the full amount, the thing that bothers me most is if i put in small amounts will i have to sign something from the bank to say i wont claim anymore,
any info much appreciated0 -
You need to read back through the posts and links on this thread. However start off your claim and should it get to having to take to court we can look at your particular claim and your options then, good luck.
Be aware if you are claiming through the Scottish Courts you can only claim back 5 years but I would suggest start your claim for the 6 years as its looking like it might be a biggish claim and probably the best bet is to put it through the Financial Ombudsman. A lot also depends on which bank it is as to if it will get to the court stage.0 -

Can anyone tell me please what the next steps are for reclaiming charges in Scotland in excess of £750 (the maximum quoted in MSE). I've got as far as receiving an offer from my bank of £858 - far removed from the £3600 I have asked back. Do I still use the small claims procedure. I'm a bit confused as MSE says the maximum that can be claimed in Scotland is £7500
