Hi, I have a similar problem but we were charged by our bank whilst we were living in England and have only recently moved to Scotland. Where would we claim? (Our account was in England)0

You need to claim where you live as ultimately you could be going to court, however if you read the links in this thread you can use an address in England or Wales if you have access to one.
Meantime start your claim in the normal way and I would suggest you claim for the 6 years at this stage.0 -
My partner is trying to put together a claim to get back bank charges from Bank of Scotland. His charges are around £4000. I think I read somewhere that the limit for small claims in Scotland is significantly lower than that of England. Does anyone have any knowledge/experience of this, i.e what the limits are, can you put in more than one claim to cummulatively get to the sum you wish to claim for?

Hi, was going to make a claim to Halifax in scotland re charges. Does anyone know if i can use the template letters on this site by just changing the 6 years to 5?

I'm currently claiming again the Halifax and I just used the letters here. Change it to saying 'Sheriff court' and the number of years to 5 (as you said).
If you send the letters to their head office on the mound in Ediburgh you'll probably get all your replies from Leeds (though technically this isn't their main office any more).
They have tried making me offers, though well short of total. I have now filed the small claims, and, contrary to what has been said on some forums, the clerk at the small claims department of the sheriff court (who was extremely helpful in answering questions) has said it is perfectly fine to split claims up into a number of small claims (I'm having to do six).

Good news Alastair that the court clerk said that about the multiple claims however the point with the Clydesdale bank is unlike other banks they are likely to send a solicitor to the court and they may use the multiple claims as an abuse of process.0

l got my charges in the post on Thursday 26/04/07 from the Halifax, £525 in total. My request was sent on the 22/2/07, well over 40 days. Never replied to any letters at any point. One thing to note though is that l sent my claim to the local branch in Leven Fife, the list of charges came from there hq in Halifax England. Any idea what this means ?0

It means the department dealing with HBOS statement requests is based in Halifax0

I have written to the bank asking for my charges back and the 14 days are up on Monday. I've had no reply (suprise!) can skip the letter taht says " unless you pay I'm now taking you to court"? and file my claim or do you recommend that I send the letter?
