    I have gone through all the stages 1 - 4 with no results. Final letter said they were looking into it. Want to take it further.

    Can I use Moneyclaim as I am in Scotland or do I have to go through the local court ?

    Can anyone in similar please advise.

    Hi all

    Just to let you know, In scotland you can claim for up to 5 years (as martin says on main site)....however, when I sent the initial letter I asked for 6 years worth of charges to be refunded (BOS halifax). I then read martins web page in full and discovered the 5 yr rule for Scotland and thought "ok, I have asked for it now, the worst they can do is say that only 5 yrs can be counted towards any claim". Over 5 yrs my total claim amounted to £746, over 6 yrs it amounted to £1076. They sent me a letter a few days ago offering me £578 as a "goodwill gesture" and requested I phone if I was not willing to accept this. I did phone and the advisor told me that they would rather settle this over the phone than go to court and asked me what I would be willing to accept. I decided to brass neck it and said I would only settle for the full amount of £1076 (6 yrs), fully expecting to be quoted the 5 yr scenario, but lo and behold, they caved and said they would pay me the full £1076!!!!!!!! NO MENTION OF THE 5 YR RULE AT ALL!!!! Now I dont know if the advisor just didn't know about it or if he thought it was worth paying the 6 yr amount just to settle & close the claim, but it is worth applying for the full 6 yrs anyway, cant hurt......

    I've recieved a list of the charges from my bank (Nationwide) and was getting ready to prepare the letter asking for the charges to be repaid however I've come across a few letter templates and didn't know which to use. One template says for when payments have been made and another says its for all other cases I don't know which to use. Some of my charges are for unpaid direct debits, a few for unauthorised overdraft, a few unpaid cheques and then there's a list of interest.

    My second point my total list of charges is £799.95 should I initiailly claim this or the £750 whihch as I've read is maximum claim on Scottish small claims system - it's inevitable I'll have to file a case.

    Last question I promise shopuld I attach a copy of the charges or list them in body of text?

    These might sound like wimpish questions but I'm not afraid to admit that's what I am!

    Any help or points in the right direction will be gratefully recieved.

    I sent the original letter requesting 6 yrs worth as I did not know that you could only ask for 5 yrs in Scotland. But thought, well I've asked for six now, the worst they can do is say no.

    Confused slightly,
    do you have to live in England to be able to use the 'on line claim' option if need be? Or it is that if the bank etc that you are claiming against, main HQ's are in England, you may use this option when the need arises?
    As there is a different system here in Scotland and different limits to the amounts you can claim, what happens if your claim is over the Scottish Small Claims limit of £750?

    Any one help?
