Hi all, I have just ordered a copy of all my old statements and I will get the ball really rolling once these have come through.
I have read through the step by step and admit I am a little confused by Scots Law.
I am from Scotland and will probably be looking to claim back alot more than the £500 that the small claims courts allow in Scotland. Does this mean I will NOT be able to make a claim? or will I have to jump through more hoops??
Can anyone please point me in the right direction?

Well lve just been to the Sheriffs court in Kirkcaldy to ask about paperwork to start a non-complience against the Halifax for failing to provide me a list of charges as required under the DPA. l was told that it not would come under small claims or summary cause. Which leaves ordinary. I was told that this would have to be dealt with by a lawyer and that none would probably touch it with a barge pole. l explained the case so far and was then advised to take it to FOS. Anyone care to add to this ? This is in Scotland0

Been on to the HMCS website and it says I have to have an address in England or Wales to send documentation to. I do not ahave any addresses in either country that i can use. What can I do please? Anyone else been in this position?0

As you are claiming in Scotland and as your claim is more than £1500 probably best that you do put your claim through the Financial Ombudsman.
iru_bru you need to read through this thread and check out the links to the Govan Law Centre but don't be put off starting your claim now as depending on which bank you are claiming from it may not come to having to go to court.
b1referee, if you are going to use MCOL, yes you need to be claiming from an address in England/Wales and in Scotland you have to file via your local court which has a limit of £1500.
