Hi there,
Just recieved my list of charges from Lloyds TSB today and just added the charges up totalling over £2000. I then read on about going to small claims court but it says in Scotland only a maximum of £750 can go through small claims in Scotland so was just wondering what would i do when i need to go to court.

Hi all.
I have been reading this site for weeks but have finally decided to post and ask a few questions, any help is very much appreciated! Here goes
*Requested statements from RBOS, received them within 2 weeks
*Sent 1st letter requesting they refund £1900 worth of charges (no
interest added) - No reply
*Used Interest Calculator - + interest they are due me £2400
*Had 2nd letter hand delivered to my branch today, asking them for £1600
otherwise will take them to Court
I live in Edinburgh and RBOS headquarters in Edinburgh, but have a residential address in England available to me.
What should i do next if they don't reply. Use MCOL and file with English address or claim through Scottish Courts but seperate claims.0 -
Hi folks sorry if this has come up before. But my problem is that my bank charges are about £4500 but I believe that the small claims court in Scotland only covers up to £1500 so what do I do about
the rest of the charges.
Also if I claim some of the interest on my overdraft and its the wrong
interest that I'm claiming back will that invalidate my claim. Thanks any helpful information.0 -
michelle, RBS are usually pretty good at making a full offer offer of your charges, obviously without interest as this only applies should you go to court, so I would go canny and don't worry about court as yet.
As you have an English address you can use, yes you could put this through MCOL and English law but would have to use an English address for RBS at this state, one of the main London branches will do.
red volvo, if you are claiming back interest, yes you need to be very careful you are accurate, please read the post about it in the Reclaim Help Thread which is linked in my signature.
As regards your claim being more than £1500, start off your claim anyway and should it come to it you can always ask the Financial Ombudsman to take on your case without it going through the courts, please check out the links earlier in this thread.0 -

I am currently in the middle of trying to reclaim bank charges from my bank, I have got to the stage with threatening to take them to court. As my bank is based in England but I live in Scotland does anybody know if I can pursue my claim through the English court system or would I have to go through the Scottish courts???0

im in the process of claiming £2222 from barclays bank thats my six years of charges including interest, ive recived a offer of £1430, so i wrote back 2 weeks agao advising that i will accept as a part offer untill i recive the full amount, and if i dont hear anything back within a week, ill be taking them to court, now that was 2 weeks ago now and i havnt heard anything back, so i want to start court proceedings, but not sure how to go about it as i now live in edinburgh, and the small claims court in scotland is up to £750, so im well over that.
please help me as i dont know what to do.
