  • I'm jumping the gun a little here, but what is the procedure in Scotland for claiming more than the small claims allowance of £750?

    I believe you can split the claim up into several smaller claims. If you go to https://www.consumeractiongroup.co.uk they have a section all about it.

    I have handed in my letter to BOS on march 1st, and to date i have still not had any letter saying that they have received it etc?

    what should i do next, i was going to phone them up today and see what is what as the 40 days have now passed.

    i have also read that you cant claim any more than £750 in scotland is this correct? if so how would i get round that as i know my charges will be much more than that

    any tips on what to do will be appreicated peeps

    l sent of a letter and £10 cheque requesting my statements as well. handed it into the local hbos. l sent a reminder 33 days later. 40 days and no statements, not even recognition. lsent them another letter stating they had 7 days to comply then l would write to the information commissioner. l got all the details for the IC but wondered what happens if l still get no word.

    l managed to check to see if the hbos had cashed the £10 cheque that l sent on the 22/2/07 and found out they had only done so on the 2/4/07.

    Could someone help me with a couple of questions please?
    The maximum amount of claim in the Scottish Small Claims Court is £750. Is this figure inclusive of interest or can a claim be made for £750 in bank charges and then have interest added?
    I have read on other threads that courts charge a fee of £100 if you pursue a claim through the small claims courts. Is this fee the same in Scotland and will it be refunded when I win?

    as far as lve read any court costs are added to your claimed amount if you win. so doesnt cost you to take it to court, if you think you can win.

    Hi there apoligies if this has been asked before i have tryied to find the anwser without sucsess.
    i am at the court stage of my claim and as i was told at local court i have to limit the claim to £1500 but i am owed more than £3000 so wonderd if i could claim with wifes name and hubbies name as its a joint account ?

    Hi.

    I have received ALL my statements from HBoS for my 2 accounts - It was a bit of a hassle - but eventually got there by going into a Branch and getting them to request them (£5 for each lot). 1 a/c had 70 pages, the other around 50.

    I had sent off the suggested 1st letter to Customer Relations (Rosyth) - no reply. Copies were then sent to Leeds. No reply. The branch tried ringing, but got fed up being piut *on hold* - so they did it.

    #1 a/c Charges of £6213.93 (using MSE.com calculator) interest = £3119.74
    TOTAL £9333.67.

    #2 a/c Charges of £11005.39 interest = £552.32
    TOTAL £16530.71

    GRAND TOTAL OWING: £25,864.38

    I need to sit down and read everything here and on the CAG website to see where I go from now!
