  • Bank charges....? I am truly demented, I sent the second letter to RBS 8th March and have heard nothing. What's next, can I in Scotland take to court online, or is it local court???? The amount is over £750, do I make several small claims?




    a hopeless computer person!!! Will be out of debt if I can get this right.....brill.

    Hi all,

    My 14 day deadline is fast approaching and its almost time for me to take the bank to court if there is no word from them in the next 4 days.

    What is the procedure in Scotland for doing this?

    Any help much appreciated.

    Has anyone out there reclaimed charges in excess of £750 in Scotland?

    I understand this is the maximum amount that can be claimed via Small Claims Court in Scotland, but I have calculated charges mounting to a lot more than that!

    Any advice?

  • The £750 limit in scotland - is it inclusive of interest and court costs?
  • I think yor right about the £750 via small claims, but as far as I know your claim can be done through the county court's
  • Hi - Just before I send the first letter off to my bank - I note that small claims equivalent in Scotland only goes up to £750.00, although I think I could pursue (I am claiming about £1400.00), if it came to it through county or other higher courts...(?) I live in Scotland but bank with first direct (in England) - as the bank is in England does this mean I can take them through the English small claims system? :confused: Bob

    Natwest have two days left to reply to my claim for £5700 and interest of £1200. I am in Scotland and now need advice for next stage. Can anyone advise me please? For the record ...they have made my life hell for some time now and I will gladly do whatever is necessary...legally to get MY money back!
  • I am also claiming in Scotland and have found lots of info on the Consumer Action Group Site. Find it a bit more difficult to look through though.
    Anyway good luck to you with your claim

    and if you want to use the Financial Ombudsman rather than go to court...

    No longer advised to put in multiple claims but don't let that stop you threatening the bank with court in your second letter.

    Charges can be added to your claim up until you start your claim at court.

    You need to study the above links and if you have an address you can use in England/Wales that would be the easiest way to go or via the FO.
