Hi I have been looking at the amounts that you can ask for back. I am just about ready to take abbey to court now I am realy worried as it says that you can only clain £750 in scotland surley this can not be right?? my claim is for 8 grand so how do I go about this???

It is indeed correct or you can go to £1500 with a Summary Clause. You need to have a good read of the posts in this thread but possibly your best bet with that amount of money is to go through the FO, link in post 314 unless you have an address you can use in England or Wales.0

I am trying to reclaim £425.75 including interest from BoS. I have received an offer of £110 which I declined and told them I would give them 7 days to refund the whole amount or I would take them to court. I received a letter today offering me £330, which is the total amount of charges minus interest. In this letter they have told me that the only way I am going to get back the interest is if I take them to court. Is this true or is it worth me sending them another letter? Or should I just accept this offer? Any help would be greatly appreciated.

im just about to put my charges in at the bank but ive been told they have capped claims to 1 per account and to £1500 but mine is double that on a joint account so could i put in 2 claims on the joint account?
is this capping rule all over the uk or is it just in scotland.
also the fees anyone else on benefits claimed on line and not had to pay them?
also is the any companies line moneyclaimonline do this for you?

Can any one tell me what todo in Scotland when your bank charges are over the amount for small claims courts eg over£7500 -

Hi there Scottishlass,
The bank is correct, if they are going to give you back all your charges minus interest, the only way to get that back is through court.
However, if you decide to claim the rest in court, you are likely to loose, as the the bank has tried to correct their error, and the judge would see that you aren't co-operating.

If it's over £750 and less than £1500 you can raise a Summary Cause action. Or you could split the claims into managable chunks. Or you could raise an Ordinary Action which will cost you megabucks as you'll need a solicitor to help you. Depends how much you're claiming for.0 -
Hi, what a fantastic site! i feel ive been overcharged for years and saw on the T.V this morning that so many people were standing up to the banks. i found this site and have been massively relieved to find other people in my situation. im going to fill in the template to find out exactly how much ive been charged, was basically wondering if anyone has had any experience of the Royal Bank of Scotland. also, i saw that in Scotland you can only claim for 5 years, is it true that the maximum you can claim in the small claims court is £750 here (Scotland). Any advice would be greatly appreciated.Cheers, Pete0

Once you get your statements/information send off your first letter asking for your charges including the 6 years and don't worry about the £750/£1500 limit meantime as you hope that in fact the bank will pay out before you need to think about going to court.
There are a few options for claiming in Scotland one of which is passing it to the Financial Ombudsman or using an address in England to get round the monetary limit.
You'll find if you read the Success Stories and this thread about RBS that they are one of the easier banks to reclaim from
