    I am still waiting to hear from FOS who I e mailed last week.
    I want to send off my second letter today to CB and LLoyds (who didn't respond to the first letter)
    Can I just make sure that it is ok to threaten court action when I am actually going to claim through FOS? Or should I make this known in this letter. It's just that there is a small chance they might make me an offer when they receive my letter.
    Also .... The CB account is a closed business account. Is there a different letter I need to send for this.

  • My bank have been chasing me for around £2000 of bank charges for the past 2 and 1/2 years - they have now sold the debt to a recovery agent who having heard my story has held up the procedings until I try and reclaim the charges. I am at the stage of going to court but don't know what letter to send or if I should be going to that step - is there anyone who can give me advice on this please - I live in Scotland. Thanks

    If your claim is for £2000 and as you live in Scotland along with it being with a DCA I would suggest you hand it over to the Financial Ombudsman to deal with for you.

    I think they reckon on it taking around 8 weeks.

    Hi, my first time on here so here goes. I am claiming from HBOS for almost 7,000 pounds in charges over last 5 years and received letter from them basically telling me they will look into it so sent them the next letter telling them they had 14 days to reply or I will take it to court, problem is I have no idea how to go about this and 14 days are almost up. I am in Scotland so really need some advice from someone who has lodged in a Scottish Court as I cannot go through small claims. Would someone be good enough to tell me how I go about this. Many thanks.

    Been reading alot of your posts and find them to be really informative, however, I'm half way through claiming ie I've sent my LBA to Lloyds TSB but my question is this... I opened my account while living in Cambridge and my account is still held there but I now live in Scotland so what law does my account come under... Can I use the online claim form to submit it to court or do I have to look at the Scottish options... I'm confused :confused::confused:

    Do you have an english address you can use for correspondance ?

    if your claim is under 750 then dont worry - but if its more then you can no longer split claims so you either go english address route - or through the FOS financial ombusdman.

  • I intend to claim my bank charges - over £750 - in an english court even though I am domiciled in Scotland (was in England for first few years charges) my bank is the BOS who are registered in Edinburgh but now they are HBOS can I claim they are also registered in Halifax. Have tried to question employees of HBOS (identity crisis depending on which service you are after) they appear to pick and chose if they are or are not merged!!

    Use the address for Halifax in post 3 in the Reclaim Help Thread, linked in my signature and put in thats its HBOS you are claiming from.

    The two actions are very similar, they cost the same to lodge in court, the only main difference is you have to serve the Summary Cause summons on the defender yourself (by Sheriff Officer). The procedure's the same otherwise.
