Reclaiming in Scotland

  • I live in England now but my bank is still in Scotland, do I file my claim with the English court or the Scottish court

    I phoned clydesdale bank leeds as they were over their time and then they said they were snowed under and to give it 2 more weeks - well just to-day before the extra 2 weeks and just over 1 month since I started this I received cheque for half the amount less interest - full and final settlement if I cash it - usual gluff and I am not sure if I should press for more as it was £742.54 which is just under the amount to claim in scotland small claims - I fancy using the ombudsman - anyone else done this with CB?
    Saving in my terramundi pot £2, £1 and 50p just for me! :j

    I'm thinking about this cos I don't want to raise an OA for a £2970 claim with CB but I have no idea how to go about it.:confused:

    OK. I've decided to use the FOS and have emailed then with my case details.
    If anyone has any expereince of going down this route i'd love to hear from you. Is there a thread dedicated to using the FOS to reclaim?
  • Hi there,
    I live in Scotland and have a current account with the alliance and leicester, i requested my statements to find out my total charges, which are £1750.00, then i wrote in to ask for them to be refunded, i got a reply within 2 weeks saying that they would not refund the charges, so i wrote another letter explaining that i wasnt happy with there reply and that unless i was refunded the charges i would take legal action. Again they said that they would not refund the charges.

    So, i am in the process of taking the bank to court, i have a few questions about this matter.

    A) when taking the bank to court through the small claims court, can i make several claims up to £1750??
    B) can i do this online or do i have to go to the sheriffs court to do it.

    C) when claiming through the small claims court, how do you work out your interest due on charges??? are these to be included in the £750 max limit when you claim, i.e can i claim £750 plus interest each time???

    IT WOULD REALLY HELP IF I COULD SPEAK TO SOMEONE WHO HAS GONE THROUGH THE SCOTTISH COURTS AS I AM STRUGGLING TO UNDERSTAND WHERE AND HOW YOU START THE SMALL CLAIMS PROCEDURE.

    ANY HELP WOULD BE GREAT!!!

  • Which court name do I inserst in LBA, I am in Scotland - is it my local Sheriff Court? About to send LBA off to the Clydesdale as just received a response to my first letter of no way are we giving you a refund letter from Clydesdale Bank!!

    You can't use the online system in Scotland but have a good read of all the posts in this thread and check out the links such as this one...
