  • Is there a thread for following the reclaim process in Scotland? I am SURE I have seen one before, but I can't find it today.

    I have just had my first refusal from the bank and have typed up my next letter, but I would appreciate assistance on the Scottish Court stuff. I have also just been on their site and downloaded the relevant literature. ;)
    Just paid off my large mortgage 5 years early and loving it.

    I'm back and I'm still panicking :o

    I sent my letter requesting charges last monday to LLoyds TSB. i know I have to wait 14 days but then do I send another 14 Day letter. All the sites I have looked at (CAG, PenaltyCharges) seem to give contradictory advice re Scotland:confused:. As the amount is over £5000 should I go for OA as there is now a problem with abuse of system and if so how do I do this and do I need a lawyer? :o:o

    Sorry to be so thick but this site is great for English claims and their system is so much simpler but Scotland seems so much more confusing.
    Can I be really cheeky and suggest that this thread gets "stickied" as it's hard to find and the discussion thread is often not relevant to Scottish claims?

    Sorry EL, I know you're up to your eyes and are probably fed up with numpties like me who want it all spelt out but I am claiming alot in total and I'm petrified of messing up.

    First of all, stay calm and wait to see if you get a reply from Lloyds and more than likely a goodwill gesture of £750 immediately. Then you can go back and say thanks but no thanks and give them a further 7 days before you go to court.

    Then we start worrying but don't forget you can get the Financial Ombudsman to carry it forward for you.

    Thanks EL. have hunted on the Freebies and Grabbit boards but can't find any cheap valium on the go:D . I really admire all on here who are so up for a fight but I have had nothing but sleeples nights since I began.:o

    What about the sticky idea? Was I too cheeky? :p

    Too many stickies as it is and that Martin keeps sticking his own threads :eek:

    What I will do though is add some threads to the post containing the main bank threads which I've had to merge with the Reclaim Help Thread in order to keep the stickies down.

    The moderator on this board posted this;
    I spoke at length with the FOS on Friday (I think this is who you mean when you refer to 'FSA' donaldtramp).

    They told me that they have a 100% record of recovering people's charges, with interest. They generally go back six years. They don't get back the difference between what you paid and £12, they get it all back. The only thing she wasn't certain about was what would happen if you had already claimed back £750 before - but she certainly didn't rule it out.

    I think this may be an excellent option for anyone in Scotland claiming back more than £750.

    If you go this route no lawyers are required. As far as I've seen the Clydesdale have been the only bank to use this abuse of process tactic.

    So there are plenty of options open to you. Don't worry about it. There are plenty of folk in here to help you out. The thing to keep in your mind is the simple fact that these charges were taken ILLEGALLY! You will get it back and trust me it's a great feeling:j :j
