  • Hi Matt,
I sent first letter to RBS and got same reply as you, i then got letter offerring me £677 (which is an eighth of what they owe) within the 14 day dead line.
I wrote back saying "NO DEAL" and told then i would be taking court action. They then replied offering me just less than half 2 days ago. Guess what? NO DEAL! am about to file on line to take them to court :-)
so dont lose heart.......... its a good start xx

Remember you are the one setting the timetable, do not wait for any reply, stick to exactly what you have said in your letter. They are the ones that must comply not you. If you have given them 14 days, write the next letter and ignore any delaying tactics they may try.
  • Hi quick update

  • Hi there

I have been a RBoS customer for approx 16 years having never defaulted on any payments until February this year when circumstances changed in my personal life since then I have accidently went over my overdraft limit a few times although this has always been paid back in full when my salary has been submitted.

The problem I have is every time I have defaulted I receive at least two letters per month thus further worsening the situation twice I have injected cash into the account yet it has dissapeared as quick as it is deposited what can I do to stop this happening I have had on customer service meeting where the kindly offered me a loan great help that would be

    any info please
  • 1. send a letter to your bank asking for the charges back, backdated 6 years (if you dont know how much that is, send a Subject Access Request form and a £10 cheque asking for copies of the last 6 years statements)

    2. if no joy, send a Letter Before Action giving 14 days for a refund on the charges or else you will sue them

    3. still no joy? sue them at https://www.moneyclaim.gov.uk

    4. you win
  • I'm about to start the the letter process with Royal Bank of Scotland, as my business is in trouble due to them charging me 2500 in bank charges!! Have tried to reason..no joy! How did you get on with the RBS so far??

  • would really appreciate advice with my RBS account, iti believe it is not a 'standard 'claim (one of which im at the court stage with (hsbc bank))

ACCOUNTS CONCERNED: rbs royalties gold, rbs loan, rbs instant saver

    PHYSICAL BANK CHARGES- circa 2.5k

CLAIM PROGRESS- statements recieved, charges spreadsheet filled in and interest calculated

    MY STORY (HERE GOES)

Since having accounts with rbs i have been charged fees when overdrawn, but the trouble really began when i changed jobs after being made redundant and i became more overdrawn , but.. when i started my new job i changed the dates of my standing orders and direct debits,
As soon as i did this RbS loans got all confused as they took 5 loan payments out in a month, then put one back. thne the same happened next month, nno one could explklain why this was happening month after month and rbs bank wouldnt help and charged me vast amounts for returned direct debits being overdrawn etc.

the staff at rbs loans new there was a mistake but didnt know why, in ithe end the situation escalated and i was DEFAULTED by the bank . i now pay 350 a month to there credit agency.

    THE QUESTIONS:

    1. I have been offered a settlement figure by the agency, of £2000 pound one off payment instead off £3500 monthly , if i make a court claim can they withdraw that offer out of spite with the agency and force me to pay the £3500 -therefore it would be better to pay off the settled figure before claiming back the money in the courts -and i would be 1.5k up?

2.i also recived Many charges from balliffs and the agency, which i dont have details of, can i claim these charges? and how would i find out them? can i contact my bank for these?

    3. as i have been defaulted how do i get this reversed? the reason i was defaulted was there fault in my opinion? do i ge tthis done through the same court claim as when i charge?
    4. i had to get a high interst loan (due to the default they applied) to pay my overdaft off to stop it going to court) can i claim the extra interest this has cost me compared to a normal loan or claim all interest for loan?

    5. i was off ill for stres during this time (for which i had medication), i had to move in with a family member and have misse dout on many oppurtunites for trips away , and now the worst thing is my girlfriend is at university in belgium and i cant afford to emigrate with this debt over my head. can i claim for these factors financially?

6, can i take this case on myself? as i dont know if i could afford a solicitor! ( im going through a 'standard' case myself ok, but i believe they have caused me extra hardship in this case)

    7. should i claim this online or with small claims,

8 is ther anytihng else i can claim forr as this has wrecked a year of my life, its held back my career for a year and i now have to fly abroad to see my gf!

thankyou very much in advance for your help
  • Just about to send my letter to RBoS in about 1/2 an hour. I am taking the approach of taking 75%. Dont need all the money (about 700) but will settle for 550. Seems fair. Hopefully will hear in a couple of days
