    It's very difficult for anyone to say whether a charge should be claimed if there is no description of what the charge was for. The £25, and £30 charges seem like they may be claimable, but this is not 100% without knowing exactly what they were charged for.

  • Ahh so the day has come... Two letters to RBS... One reply saying 'yeah we're still waiting for head office to send us some of your statements' and that's it. How long will they get to reply and also I'm guessing bank holidays/weekends don't count?

    The banks have 40 days (just under six weeks) in total to supply your information under the Data Protection Act. Some banks reply quickly (one or two weeks), and some reply just in time for the 40 day limit. You just have to sit and wait for them. Weekends/bank holidays don't count as extra time under this deadline, it is 40 days from when you made your request.

    Oh sorry I phrased it badly. I got the statements in seven days but the branch was like 'yeah we're waiting for our copy'.... Can't they just look on a computer?

    Have you gone through all your statements to make sure you have all the dates? Sometimes they send out the full six years worth in seperate batches (you may only have part of the six years worth).

    If you have all six years worth. Total up all your charges, and move onto sending your first letter along with a list of the charges (set them out date/charge/amount). HERE is an example.

    Sorry I don't think you get it. I have all my statements since the account opened. I've done the whole 28 days thing. Ive sent my claim.
  • Hello guys/gals,

    I previously was a Royal Bank of Scotland account holder. I had an overdraft limit of about £800 and was constantly going into it. I then lost my job and about 2 months later the bank called me. They were a concerned as my regular salary was not being deposited and asked me to pay up the amouint i owed. I was thrashed with charges left, right and centre.

    They subsequently took action by closing my account down and passing my details to a collection agency to recover their costs. I was also told that i could never become a Royal Bank of Scotland customer again.

    Since then i am back on my feet and have closed the balance in full with the collection agency. I am now banking with Abbey.

    Without babbling on, can i still lawfully pursue The Royal Bank of Scotland to recover my charges?

    RBS acknowledged my claim on Dec 28th, I've sent another copy of my charges and they have until the 24th Jan. I hope they don't bother defending.
  • Hi there, I'm a student and currently in my overdraft at about 1300. I really want to claim back the charges as they total around 700 pounds and that would be a big chunk off the overdraft but like most people I'm worried they will demand the overdraft be paid off in full

    anyone have any experiences of claiming when in a big overdraft?
