  • great, thats not what I wanted to hear, altho some experiences on this forum are positive, so I'll just wait and see.

    Not sure I'd have the balls to threaten them with court action tho - think I'd back off before they do - but then that's what they want isn't it?

    That's exactly what they hope you'll do. You can try and claim and you may receive a partial offer, but in all honesty many banks are waiting until you file the claim before paying up. As long as you follow the instructions, you should have no problems filing your claim and getting all your money back.
  • thanks Nickmack - I'm going to try my best to keep fighting this one and not give in - its over £2500 I've claimed for and a couple of grand would come in very handy right now - would half my credit card debt :D

    To use moneyclaim it says I need a english address but the one listed on the 'address thread' is in Edinburgh. What should I use?

    Hi everyone Still not posted my 1st letter. Im struggling with these charges.

    There is only one charge that im not sure about and thats below:

    INT TO 22oct - A/C ******** 35:67
    CHG TO 22oct - A/C ******** 40:00
    These charges are on my statement every month on the same day, right next to each other.
    I know the top one is interest and as such cannott be claimed for, but the bottom one `CHG` varies every month. I have a royalties gold account and i think there is a £12 charge per month.

    As i am permanently o/d i think this varying charge every month must be the £12 normal account charge plus extra charges for going over my limit (for this month £28)

    My point is this, can i claim back this extra ammount of £28 (£28 + £12 =£40)
    and if so, do i claim back the full £40 or do i have subtract the £12 from each monthly charge?

    Or is this charge not claimable as it is a justifyable expense for the bank

    You cannot claim account charges i.e. £12, but you can claim any other penalty charges that have been applied.

    You need to determine whether this monthly charge is included in the total charges. If it is then you can remove the £12, otherwise, you can claim the lot.

    The spreadsheet already provided on the site should have spaces for date, charge and amount.

    I actualy contacted my bank about the above charges and they told me it is made up from £12 account charge and other charges for going over o/d etc.

    So tve entered these charges into my spreadsheet LESS the £12 for each charge, yet when i get to earlier years the charges range from £5,£10 £7:50,£25 and even £30 SSo there are three charges (5, 7:50 and 10) obviously less than the £12 account charge.

    I am banjaxed, do i just enter these lower charges complete

    Please somone save me from cranium melt down!
