Hi im a newbie, and would love to claim back on charges from my bank and credit cards. The only thing is im in a bit of a rut at the moment, not helped by these charges! I have an overdraft of £3000 with Royal Bank of Scotland, im in this every month, if i claimed my bank charges would they close my account and demand the overdraft back? and would the same go for my 2 credit cards, i have one with Capital One and one with Egg, would they also demand there money back? If i could claim some charge money back, it would help me to get out of this financial rut!0

I have not heard of any of the banks/cc closing the accounts though this isn't to say they won't. I would go for it though i just claimed back £1200 from RBS and they paid up before the court date - good luck0

To everyone who is claiming or considering claiming from the RBS-Go for it!
I claimed back £3700 in October, it took a total of four letters and two of them were rejecting low offers! while I was waiting on them depositing that money they took another £200 out of my two accounts! Another letter and they are now paying that back too. I never thought i would get out of my overdraft but now i dont think I will ever go over my limit again.
P.S. they have never threatened to close my account.:beer:New comp-a-holic!!:j

I am currently in the position where by, i have taken RBS to the online court, the claim was issued on the 8th November and assumed delivered by the 14th November. 14 days past and RBS issued and acknowledgement, a further 14 days past until today, the 12th December. I was then allowed to issue a judgement on the basis RBS did not enter a defence, which i did at 8am this morning. Since then the online court must have recieved a defence today after i issued the judgement.
I have also recieved a demanding letter from RBS solicitors today asking for all sorts of information. Please can someone tell me if my judgement issue will stand and RBS have lost due to being out of time, or will i now have to attend court?
Advice would be apreciated0 -
Following on from my last post, i have checked the online court claim website and they have rejected the judgement i filed this morning. I am assuming this case is now going to court. As i mention previously, i now have a letter from RBS's solicitors asking for a statement of charges again. Can anyone tell me if i have to respond to RBS's solicitors or do i just deal with the courts now?
Any advice from here on in would be appreciated. thanks0 -
It appears you are now dealing with the court, from Martin's article...
- VICTORY. The claim’s acknowledged but there’s no defence. Banks have 14 days to acknowledge a claim, if that’s done they have a further 14 days to respond and enter a defence. Commonly they do an acknowledgement, but no defence is entered. Again this means you win, though this time after 28 days. At that point, immediately request a ‘judgment by default’, this can be done online.
- It defends the claim. If you’re one of the rare cases where the bank does enter a defence, don’t worry too much. You’re now in the Court process. There’s a straightforward form called the Court Allocation Questionnaire which you need to fill out and return to Court. If you are in this boat, there are many consumer organisations willing to provide help and guidance and back you up, see further resources.

Hey Guys.
I am a RBoS account holder, i have a savings account with about £5 in it, and in the other account i have an overdraft of £1,500, since i started Uni in 1999, i think the main reason for this was they were on campus. I digress, I have been hit with charges pretty much every month for the last 12 months. I was a student (again) and so didn't having any funds going into that account, i also opened up a Lloyds TSB account 15-18 months ago, finding them much friendlier. I tried to change my account back to a student account, while i was doing my masters, i couldn't afford the month after month of charges, and they lost my paper work, so i was hit with more charges again. I have been up happy with the RBoS for some time now, throughout the 7ish years i have this account i have been charged again and again. I am about to send off my first letter, i have been think back and i really think i could clear my overdraft with the amount they have charged me. I remember one summer away (about 10 weeks) and i came back to about £150-£180 of fees. Wish me luck

EDIT: Hey Guys i have a small question, for the RBoS does "maintenance charge" = charges for going over overdraft/bounced dd's and the like? If so just did some checks and with interest, for the charges i know of, £590.43..... i could clear half my overdraft with that.0 -

anyone know how long it normally takes for them to get back to you?
I sent mine off last week (Thursday I think)
do they normally say no first off? As I reckon they might, because they are a fairly strict bank?I have no more money to give - all you companies out there - do your worst - I give in!!0 -

From what i have read, they will take you to your limits, you will probably have to take em to the court level.
