I am from Scotland and have just sent letter away to lloyds . I have recieved all the listing of charges so i have asked them for a settlement . I know the small claims in England is up to £5000 but only £ 750 here .
Edinburghlass advised me to proceed regardless and possibly pursue thru the Financial Ombusman.. we will see . Still trying to ge used to this site as my messages keep getting moved .. i must be thick !

Hi , thats me got the hang of it now ... reclaiming in scotland thread . I was all over the place trying to find my posts !!
It only took about 2/3 weeks for them to return the lists . I thought it made a mockery of the whole thing as they only charged £ 10 for the info and they were both about 20 pages worth yet they charge £35 for a missed direct debit that only requires 1 small computer generated letter !! An admission of guilt if there ever was one
I , like you , was a little concerned / confused / angry about the SCOTTISH DEAL stating ts only up to £ 750 in the small courts . Just had a look at the Govan Law Centre as advised in previous posts , and as Edinburghlass sugested the Obnusdman is an option .
I have sent a letter away today claiming 3.5k back and I will let you know of any developments and my next move . I think if they reject , the next move by me will have to be spot on .

has anyone gone through the scottish system and won? I understand that I cannot take bank to court via internet system, and what was your experience? I'm also wondering how to claim when amount is more than £750; ie make more than one claim at the same time?0

How do you make a claim over £750 in Scotland, when £750 is the maximum you can claim through the small claims court?0

Please bear with me folks because I'm new to all of this!!
I've asked the Bank of Scotland (branch based in Scotland - I now live in London) for my last 6 years statements (I wasn't aware that for Scotland its only past 5 years - I should have read up a bit more). They got back to me but they only gave me statements from May 2004 - bizarre me thinks? I am a bit anxious to move onto the next stage though, which is pobably exactly what they are wanting me to do, but to be honest I dont think I had many charges pre 2004.
I've added up the charges post 2004 and they come to approx £650. I also have about £225 of interest debited. Now I know this interest was as a result of my charges because I had stopped actively using this particular bank account and so it wasn't because of my spending that made me go into overdraft.
Is there any point in me trying to claim back the interest debited? If so do I highlight these two figures seperately in my letter?
This Scottish/English law is confusing me too....

It could be that they will still send out the info/statements pre 2004, you need to go back to the bank and ask them about that information.
As you live in England you will be claiming under English Law and can claim back the 6 years and use MCOL if you wish. If it comes to filing on MCOL remember and use the HBOS address in Halifax and not the registered address in Scotland.
As regards the interest, yes if it was due to the bank charges only you can claim that back. Have a read of the Reclaim Help Thread, link in my signature and Rex Mundi has a post explaining this.0 -
the bank is lloydstsb in scotland , but i now live in england 450 mile away. will i have to travel back to scotland or can it be sorted in england i have over 4k to claim and it will be a bit awkward to claim 5 times or more.What goes around - comes around

As the above post, you live in England so will be claiming in under English law and send the letters to Lloyds HO in England rather than your branch.0
