HI
I have handed in my letter to BOS on march 1st, and to date i have still not had any letter saying that they have received it etc?
what should i do next, i was going to phone them up today and see what is what as the 40 days have now passed.
i have also read that you cant claim any more than £750 in scotland is this correct? if so how would i get round that as i know my charges will be much more than that
any tips on what to do will be appreicated peeps
You need to phone the bank and tell them you will report them to the ICO regarding not receiving the statements within the 40 days. Please have a read of these links regarding claiming in Scotland.
Have a read of this website...
http://www.govanlc.com/jurisdiction.htm
and the Scottish Courts website...
http://www.scotcourts.gov.uk/library...ilCourts#civil
and if you want to use the Financial Ombudsman rather than go to court...
http://www.financial-ombudsman.org.u...harges_a1.html
No longer advised to put in multiple claims but don't let that stop you threatening the bank with court in your second letter.0 -

thanks edinburghlass for the help
i have called them and they have told me that due to the volume of requests it is taking longer than expected, she said she has put in another request for me.
is this a normal thing or is she trying to fob me off?
thanks in advance0 -
l was thinking that due to the amount of claims that must have appeared due to sites like this one they are totally swamped . but still doesnt mean they dont go by the rules as stated to allow them to respond with statement etc0

thanks for your reply
i am not sure what to do now, do i report them to the ICO? or do i wait and see what happens? she also mentioned the bank holiday wil lhave held it up, but that is only by a few days not weeks!
any advice on this one?0 -
I sent my first letter around three weeks ago and still haven't heard anything. To prepare for possible outomes, I had a look at the money claim online and discovered it only applies to England and Wales. Does anyone know what the equivalent procedure would be in Scotland?0

i just got a letter back from HBOS and it took 8 weeks,(thats how long they are allowed to take)so dont give up i got back approx 80% of what i claimed (no interest)as i see it ,it was money i would never have seen again, i`m not greedy just very happy with my lot . so keep going i never even got as far as theatening them with court action , follow Martins advise and you wont go wrong and good luck:j0

I am from Scotland and have just sent letter away to lloyds . I have recieved all the listing of charges so i have asked them for a settlement . I know the small claims in England is up to £5000 but only £ 750 here .
Edinburghlass advised me to proceed regardless and possibly pursue thru the Financial Ombusman.. we will see . Still trying to ge used to this site as my messages keep getting moved .. i must be thick !0 -
About to get shifted again deeks67 into the thread about Claiming in Scotland where most of the answers and links can be found
and to answer angel31572, there is no online system for Scotland, if you live in Scotland you need to apply to the local court yourself however have a look through the links in the Scotland thread.0
