    Start your claim with 6 years, its only at the court stage if you are claiming in Scotland that the 5 years kick in.

    Depending on which bank you are with you may get your charges back without the need to threaten court.
  • Can you please provide some advice on the best way forward to claim bank charges up to a total of approx £8000 excluding interest against the Bank of Scotland through the Scottish Claims System.

    Can you please advise the total number of years you can claim in Scotland?

    Would you advise to pursue interest on a claim of £8000 plus.
  • i have just wrote my second letter to my bank demanding my money back or i will take them to court

    my charges without intrest total £ 7301

    is this amount too big for small claims in scotland or do i actually have to take them to normal court ?

    im getting a bit worried but i am so determined that i will do whatever necessary to get my money back from these loan sharks

    any advise would be appreciated

    Have a read through the previous posts in this thread as to the options for claiming in Scotland.

    However, if you have reached the court stage with these large claims your best bet is probably to put it through the Financial Ombudsman who will finish the claim for you without going to court.

    It states that small claims go to a maximum of £750 in Scotland - has anyone claimed charges back totalling more? If you have then how did you go about it from the court threat onwards? Many thanks! Si
  • Hi ther sent the bank 14 day letter. Got response saying they have 8 weeks. Sent another 14 day letter stating I was unhappy with their response. They didn't even acknowledge it! Just sent a letter saying thry're still investigating!

    Ready t ostart court proceedings but am really stuck as to how I start this. 14 days were up last Thirsday so really keen to get the ball rolling. Is it different for Scotland and can anyone give me an idiots guide for help!!!!!!:rotfl:

    Hi,

    I have requested 5 years worth of statement from BOS which i recieved quickly.
    I have sent the first letter requesting payment for 5 years and had the usuall letter back stating they will respond in 8 weeks.
    Can i now ask for 6 years in the second letter, though this does mean asking for more statements? or should i just stick to the 5 years i initially asked for?

  • I believe that the whole 8 weeks thing is a load of tosh - please corerct me if im wrong - and you can go to the next stage after giving them a reasonable timescale.
    I got the 'eight week' letter 2 and a half weeks ago and ive heard nothing back since then so I'm now considering moving onto the next template letter.

    Don't wait the 8 weeks although I would give RBS a bit of leeway as they seem to pay out before you reach court stage.

    Have a read of this success story re BOS and putting it through the FO :)

    Hi there, I am also in Scotland, Bank of Scotland and have just received an offer from them this morning for all charges and interest totalling £6,429.00. I too was unsure of how to go about the court proceedings as taking them to court for this amount may have been expensive to me so I did as was suggested to you by Edinburghlass and put my claim in the hands of the Financial Ombudsman Service. They took just over three weeks to get me a successful offer which was the first offer they made and was for the total I was claiming so you will definitely be in good hands if you go by that route.You can also print off the appropriate form for them to start this claim for you on their website. I doubted I would get anywhere near my total amount but I was successful so stick with it.
