I started my claim at the end of Jan this year and used all the template letters from this site, also asked for interest. Got to the stage where I threatened court action and they were still delaying so I put my claim into the hands of the Financial Ombudsman Service who received an offer from the Bank with 3 weeks. Absolutely Delighted folks.

I am also claiming off the BOS for just over £2000. I wrote asking for repayment on 19th April. Received a reply saying looking into it etc. I was advised by the FOS that I had to give them 8 weeks. Did you wait this length of time before threatening court action? If not, how long did you give them and did you wait the 8 weeks before passing it over to FOS.

I have just recently had an offer from Bank of Scotland for my total charges and interest totalling 6,429 pounds so if you want to claim the interest then go ahead. You can only claim for 5 years back charges in Scotland.
Could you please tell me if you received your offer before court action or afterwards?0 -

Just received a letter from the bank today refusing to pay the charges I was claiming. I have now written a letter to the Bank asking for the charges or I will pursue court action I have to say it is quite scary and I am wondering whether to continue. One of my worries is that if the bank come back and say that they are still not paying out then I will have to file a claim at court, but I am confused about the small claims court procedure here in Scotland. On Martins website it says that the maximum claim for small claims court in Scotland is £750 but I am trying to claim back over £3000 in charges and I'm not sure what to do at that stage. Is there another court that will deal with larger claims. Totally confused!!! I would be grateful if anyone could offer advice.0

Hi John, I never went the court route as my totals were way over the small claims and summary clause amounts so when the Bank ignored my letter threatening court action I simply filled in a form with FOS, gave them the last letter I had received from the Bank delaying yet again and a list of the charges I was claiming plus interest and they took it from there. Hope this helps.

Hi, im new to this forum so hello first of all and well done to you guys.
my question is, my charges against the TSB have amounted to over £2k and as im in Scotland and the small claims court here only supports claims up to £750 i was a tad confused as to my next move, ive reached step 4 in that i have re-sent the letter demanding the total charges + interest be re-paid or i will start court proceedings. im unsure as to what my next move is if i here nothing back like i did after the initial letter asking for the charges back.
any hep / advice?
