Im from scotland and my bank hasnt replied after i sent the second letter saying i would take them to court. I have no idea how to go about taking them to court. There doesnt appear to be any infomation on the site about taking banks to scottish court. If anyone has any info id be really gratedful:rotfl:0

I've just started looking into this as I belive I've clocked-up a good few unfair bank charges over the past 6 years and want to try and claim them back.
From looking at most of your success stories many of you had to make an online claim before the banks paid-up.
But from reading the main info the online claim is only available for England and Wales (and Northern Ireland) - I'm from Scotland, so what option do I have?????

The Royal Bank of Scotland owe me well over £5000.00. They have given me a very hard time while we were already having a hard time! On top of that they converted my resulting increased debt with them into a huge, never ending, high interest loan. Thanks RBS.
A refund of what they "stole" in the form of bank charges would be life changing. I am about to send letter 2 asking for a refund please. I have opted not to mention interest, I'm worried that the amount would be so big the bank will take a stand and fight it hard.
Looking ahead, it seems likely that I will have to go to court. As it won't be a small claims issue (I'm in Scotland), I'm wondering if anybody has experience of this? Its not as if we can easily afford it!

I'll pop your post in the Reclaiming in Scotland thread but due to the amount of your claim you will probably be better putting it through the Financial Ombudsman once you have tried the letters etc.
Although RBS are pretty good at paying out if you give them a bit of time.0 -
Hi,
I've just received my list of charges.
Halifax £1800 over 6 years and BoS £800 over 3 years so probably about £1500 when I get the rest of the statements.
Sorry to go over old ground but I live in Glasgow and was going to use an address in Wales for my claim. As I am ready to send my first request for reimbursement do I need to use the Welsh address as a correspondence address or do I only need to change to that address when I am threatening court action?
I've also noticed that another option is the FOS. Does anyone have any views as to what is the better option for me?

I knew I had payed plenty of charges, I was thinking about £2000-£3000. just received a print out at weekend, to my astonishment they amout to £8476! But living in scotland & claiming of BOS I believe the max amount in the small claims court is £750. Please can someone advise as I dont know where to start and Im already scared! Incidently I can't say what charges where for what.0

This does put it well above the limit for a small claim, either side of the border. Getting professional legal help, on a "no win, no fee" basis, could be a wise investment.The acquisition of wealth is no longer the driving force in my life.0

Thanx for that! Where do I find that, I've read that these companies are getting 25-40% for thier services! Also what about the FOS? is that an option?0

There is no such thing as a "no win, no fee" company, they will tie you up in their contract so please don't even think about it. If you decide to use a solicitor, pay for a proper one.
Read the links in this thread and consider using the FOS should your claim come to the court stage.0
