Hi
I have written to Lloyds asking for £4000 charges to be returned. Fobbed off the first time with usual pleasantries letter, followed up with threatning response, had no reply as yet. Can anyone tell me the next route of action in Scotland as it is obviously above small claims court amount.

Have a read of the previous posts and give the bank the time to reply to your LBA. I would say your best option with Lloyds is probably the FO who will take on your case if you have been dealing with the bank for 6/8 weeks.
However, if the bank come back to your LBA its not a bad idea to reply saying you are passing it to the FO and see if that brings a result.0 -

I am new to this so hope i do it right!! I am in process of reclaiming charges and feel that my bank are going to push me to court stages I am not sure which court I use. Should I use the andover court and claim on the english system as I am dealing with TSB although my original letter was sent to scottish branch and I live in scotland? Any advice ?0 -

I've just received my list of charges.
Halifax £1800 over 6 years and BoS £800 over 3 years so probably about £1500 when I get the rest of the statements.
Sorry to go over old ground but I live in Glasgow and was going to use an address in Wales for my claim. As I am ready to send my first request for reimbursement do I need to use the Welsh address as a correspondence address or do I only need to change to that address when I am threatening court action?
I've also noticed that another option is the FOS. Does anyone have any views as to what is the better option for me?

Hello again. Sorry to repeat myself but is there anyone out there living in Scotland who has used an English address? Did you use your English address in the initial request for a refund or only at the threatening court action stage? I don't want to send the letter until I know as I'm scared to make a mistake.
I noticed in another thread that someone wanted more guidelines covering all eventualities and was promptly shot down in flames as being too lazy to read through the thousands of messages in the hundreds of threads. As I don't want "spoonfed" I've read through a lot of the messages but can't find the answer to my specific question.
p.s. I can't help noticing the amount of people who come on and say "I'm new to the website, live in Scotland, want to claim more than £750. What can I do?" These are obviously people who haven't read through the forum and have incurred everyone's wrath in the above mentioned thread. Perhaps we could cut down on a lot of these repetitive questions if the "how to reclaim bank charges" guide on the homepage dealt with the Scottish situation in more detail, explaining the options available.0 -
I have went through the process of reclaiming charges from Bank of Scotland - charges are just over £900 - got an offer letter from Bank of Scotland for £400 in October - due to stupidity I did not reply to either accept or reject the offer within the six month limit - can anyone advise what the best way forward is now0

Can anyone advise? I live in Scotland, and am claiming from Northern Rock bank - they are an English based bank with branches in Scotland. Anyway, Martin's advice for Scottish courts is for small claims court - the amount I am claiming is well over the £750 limit for small claims court. The bank has written after my initial claim, refusing to pay, stating the charges were fair. What can I do now? The download letter is not appropriate. HELP!!0

if so it sounds as though it aint worth the hassle,the amount im due is over £5000 i know the scots have been gettin shafted for centuries but this just takes the biscuit!!

The maximum small claim is £750. you can use summary clause for up to £1500. I am in similar position as the amount i am claiming is over £1500, i am going to go through financial ombudsman first. The other option is file more than one claim.0

In fact filing more than one claim at the same time can be seen as an "abuse" by some courts so due to the size of your claim you would be better going through the Financial Ombudsman once you have been dealing with your claim for 6/8 weeks.
