I need help reclaiming bank charges from Lloyds TSB. I live in Scotland and can't understand why can only claim £750. My bank charges total £8000. I have sent standard template letter to bank saying I will accept £5000 in settlement but 14 days have passed and I haven't heard back yet. Was going to proceed with money claim form but realised only if you live in England or Wales. Can anyone advise me on what to do next.

Hi I am in the process of taking abbey to court. I live in Scotland and heard about the £750 but I went into the sherriff court last Thursday and was told that is right about the £750, what was said if your claim was up to that amount then you can claim it no bother, But over that amount then you have to get a solisitor, I have been and got a solisitor my appointment is this comming Wednesday so will let you know what is going on (hopefully).

My claim is for 8 grand that is with the intrest added on at 28.5% as they had charged me that.
I also had £620 paid into my account as a good will gester but no thanks wrote to themto say so but the dirty soand so's charged me £4.00 for transfering the money over to my husbands account so I went into the bank
and closed my account down as the £4.00 had put me in arrears so I told them do not think to even think about putting charges on.

The FO will take your case on once you have been dealing with the bank for 6/8 weeks but to be honest in fact RBS are pretty good at coming up with a full offer if you give them time.

Hi, I understand what you are saying about the Royal Bank of Scotland but I am with the Bank of Scotland and have been hearing and reading about people having alot of difficulty with them paying out. After receiving my bank statements from the BOS I sent them a letter requesting that they pay the charges dated the 24th April and received a reply regarding only one of my accounts where they refused to pay. I was now going to send them the letter threatening court, do you think this is the next step I should take. I must admit I find it confusing and pointers are great, thank you.
  • Hi first post! Have been reading this site for sometime with help on claiming back my charges and found this very useful, am looking for some help on how to claim at court in Scotland for over £3000. I have sent the bank the letter advising that if they dont reply with 14 days going to take the court action, no reply from them i called the customer relations unit and they informed of a 6-8 week back log ( Royal Bank of Scotland). Have been to the Sheriff court who advised cannot go to small claims as too much! - help would be greatly appreciated.
  • Hi

I tried to carry out the online court claim but it turns out that I need to have an English address in order to claim from the A&L. As I live in Scotland the small claims court limit is £750 and as my claim is over a thousand, does anyone have a solution for me? I'm nearly going off my head with this.

    Sheila:confused:

You need to have a word with the friendly people at your local county court. The procedure is basically similar, but it just has to be done the old-fashioned personal way, not using this new fangled "interweb" thingy.
The acquisition of wealth is no longer the driving force in my life. :)
  • Is it worth getting one of these online solicitor groups to do it. No claim no fee ones?

I'll pop your thread into the Reclaiming in Scotland thread where you'll find a lot of other options.
  • Got a letter from Lloyds TSB a few days ago explaining what the charges were all about etc, basically saying I was getting nothing from them.
Seems like a good time to hand my case to the FO to me.

Does anyone know how long they usually take to deal with a case ?
I'd imagine that they're pretty snowed under.

Hi there, I just recently got an offer in full settlement of all charges from my Bank including interest and it was handled by the FO. From when I sent my claim form to them until the day I got the offer it was about 3 and a half weeks in total. Hope this helps.
