The Financial Ombudsman is wonderful - so when its stalemate with the bank - photocopy all the letters and stuff together and send it recorded delivery to the FO - you can download the forms for them off their website and believe me they work very well. I did not have long to wait for them to deal with the bank and when the bank received their letter - lo and behold they paid up the rest of the money. Do give it time and it will be worth it - I got back double the £750 limit so really worth giving this a go. Listen to Edinburghlass - she is a marvel.Saving in my terramundi pot £2, £1 and 50p just for me! :j0

I started back in Nov 2006 the process of claiming back £1600 from the Clydesdale. Since then I have sent 5 letters, one of them including all the details of the charges I am claiming. I did this after the bank charged me £10 for the statements and they then wrote to say that they hadn't received my detailed breakdown (it was sent recorded delivery and signed for);I resent all the details again. It is now 4 weeks since I sent this last letter and their has been nothing back from them.
I know the rules are different in Scotland from England; do I now go to the Small Claims court or do I send another letter.
Any advice would be appreciated.

Given that you have seen what happens when you keep sending letters plus the fact you are claiming over £750 (I got the impression from your post that you were in Scotland too?) could I suggest that you write to the Financial Ombudsman stating your case rather than using the court route.Hamsters have no tact and diplomacy, nor do they want any.0

Grant I'll pop your thread into the Reclaiming in Scotland thread in a minute but my suggestion to you is tomorrow put your claim over to the FO, you'll find the links in the Scotland thread, as your claim is over £1500.
Many users have used this now, they are very helpful and although they will say it could take another 3/4 months in practice it takes about 3/4 weeks!0 -
Hi all, I know this has probably been covered elsewhere but, my charges for the last 2 years come to £6343 and needless to say I want the lot, however, as I live in scotland and (currently) bank with the bank of scotland, the small claims limit is £750, any advice on how would be greatly appreciated, I am up to letter 3, telling them I will take them to court unless the pay up, but it is now 2 weeks since I posted that letter and I've had no response,( I gave them 7 days to reply). I am considering going to the ombudsman, is this a good idea?0

Hi. I am in England but making a claim against RBS £3200. Would this go through the Scottish court as their head office and I pressume registered office is in Scotland??
I have just sent list of charges off to them - as this is Scotland is it the same procedure - 14 days?0 -

It's where you live that counts. You are subject to English Law.
Although it is okay to use the RBS' Scottish Head Office address, it can be less complicated to use their English head office address in London.
