You can have a go at ploughing through the Scottish Claims thread for the details, but a short answer would be for you to use the Financial Ombudsman option. Even if that fails you still have the courts to fall back on.Hamsters have no tact and diplomacy, nor do they want any.0

im at stage 4 of reclaining and have heard nothing for over 4 weeks. bit unsure of next step as i am in scotland and i think procedures are diffrent up here. anyone give me advice as to what to next step is, cheers0

Have a read of the previous posts but a lot depends on the amount of your claim. If its over £1500 you are probably best to hand your claim over to the Financial Ombudsman, links are in this thread.0 -
The following link is from Govan Law Centre, based in Glasgow. They are quite categoric that the laws of jurisdiction come into play when dealing with the banks.
Can anyone here confirm that we in Scotland are able to use the English Courts system, which court(s) should we use and anything else that may be relevant please?

I would much prefer to use the English laws than Scotland due to the amounts involved in my two ongoing claims with Alliance and Leicester and The Woolwich (Barclays).
Thanks very much in anticipation of your assistance0 -

Hi there. I can't really answer your query re the courts but have you considered using the Financial Ombudsman? I did as both my claims would have required a lawyer to go to court under the Scottish system and the banks settled with me within 8 weeks.0 -
No I hadn't really thought of using them actually. Can you give me any further hints on how to do this from Scotland against two "English" banks?0

Can someone please help, is there a letter to send to the bank stating they will be reported to the FO or is this covered through the second letter
thanks sam0 -
This is a Link to their site.
I claimed against LTSB and Clydesdale.
You need to start the process yourself with the first 2 letters in the help thread. Then contact the FOS asking them to take over. They send you a form which you fill out and return with correspondence from the bank and they pursue it from there. They told me it would take 8 weeks but I contacted the bank myself first on the 3/3 and again on 17/3. Then the FOS on 2/4 and both banks settled in full on 14/5.0 -
Hello again,
Done all of the initial request letters, been all of the way and now at the stages with both to take them to court as refusals have been received from both banks to payout etc etc.
Is there a set format for wording the Financial Ombudsmans complaint forms?
I really dont want to mess this up at the last stage as I am talking about £1200 from A & L and over £4150 from Barclays and this would mean a whole lot to my family if I were to get these charges returned!0
